HomeMy WebLinkAboutCity Council Resolution 2013-324CITY OF PLYMOUTH RESOLUTION No. 2013-324 A RESOLUTION APPROVING A PRELIMINARY PLAT, FINAL PLAT, AND DEVELOPMENT CONTRACT FOR ZEHNDER HOMES, INC. FOR "MAPLE CREEK 3RD ADDITION" FOR PROPERTY LOCATED AT 159 30 29TH AVENUE (2013063) WHEREAS, Zehnder Homes, Inc. has requested approval of a preliminary plat and final plat for the roughly 0.63 -acre parcel presently legally described as follows: Lot 1, Block 1, MAPLE CREEK 2N" ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat request at a duly called public hearing and recommends approval; and WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Zehnder Homes, Inc. for a preliminary plat and final plat for Maple Creek 3'a Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A preliminary and final plat are approved to allow the property located at 15930 29"' Avenue to be subdivided into two single-family lots, in accordance with the plans received by the city on August 6, 2013, except as may be amended by this resolution. 2. Prior to recording the final plat, the applicant shall enter into a development contract with the city for installation of required public improvements, and shall provide the financial security required by the contract. 3. Prior to recording the final plat, the existing detached garage and storage shed shall be removed from the north portion of the site to be platted as Lot 2. Res. 2013-324 File 2013063 Page 2 4. Prior to recording the final plat, the applicant shall pay the park dedication cash fee in lieu of land dedication for one new dwelling unit, in accordance with the dedication ordinance in effect at the time of filing of the final plat. 5. Standard Conditions: a. No building permits shall be issued for constriction of a new home on Lot 2 of the proposed plat until the final plat is filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. d. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
