The Council has scheduled November 12 at 5:00 p.m. to interview youth applicants for the
openings on the Youth Advisory Council. Four out of the five applicants are able to attend the
interview.
Attached are the applications, a current roster, and a Resolution appointing students to the Youth
Advisory Council.

1. PROPOSED ACTION
Discuss and amend as needed a proposed policy to guide the sale of City -owned properties.
2. BACKGROUND
The City recently sold seven single-family homes that had been acquired as a part of the
Highway 101 project. While the City has purchased homes for parks and road purposes before,
the re -sale of such properties at a later date was unusual and unprecedented. Other than the City
Charter requirement that a public hearing be held before the sale of real estate, the City does not
have policies or procedures guiding how such re -sales should be handled. The City Council has
suggested that relevant policies be developed to guide future actions.
3. DISCUSSION
Before developing new policy, it is helpful to review some of the things we learned as we sold
the Highway 101 homes over the last year:
Appraisals are not the best predictor ofsale prices. The appraisals that the City obtained when
the homes were purchased were not very helpful in determining a sales price later on. Such
appraisals do not seem to adequately consider all of the factors, especially such items as physical
condition and cosmetic issues that can significantly influence a potential homebuyer.
Maintaining homes is not a "normal" Cityfunction. No City Department has, as part of its
normal responsibilities, the function of maintaining such properties. While there is some
expertise on building maintenance among City staff, it is scattered among several departments.
There is no single, logical staff assignment for day-to-day property management (such as
security, utility bills, insurance, snow removal and lawn mowing.)
The City is not a "normal" real estate seller. The process that the City used to select a real
estate agent, approve listing agreements and sales prices and to review and negotiate purchase
offers was not what is customary for residential real estate transactions. The buyer may have
very different expectations when the seller is the City. Selling a property "as -is" may not be as
easy as it would be for a private party. And there may be expectations that such properties will
be great "bargains" or that the City will reduce prices to make housing affordable. Bidding wars
and disclosure of information in purchase offers at public meetings are not typical in the
residential real estate market.
Timing can be a problem. Typically we like to have Council agenda items submitted on a time
schedule that allows for thorough review and analysis. When multiple offers could be submitted
right up to and during a meeting, thorough review (including the important step of City Attorney
review of purchase agreements) is difficult. The City Council meeting schedule in itself can also
be a challenge, making quick response to offers difficult.
Roles and responsibilities were not clear. The authority of the staff/Council committee set up
for the Highway 101 homes was not clear. With the first homes sold, the group thought it could
review purchase agreements and make changes (counter offers), and accept an offer contingent
on City Council approval. Later it was determined that the entire Council wished to review all
offers.
4. RECOMMENDATION
Each situation in which the City acquires real estate will be unique. It is probably not possible to
develop detailed procedures now that will apply to every situation in the future. However, we
have developed a list of issues that should be addressed.
At the time the required public hearing is held, staff should be required to present a draft plan for
the sale that addresses the following issues:
Name the person(s) or committee who will represent the City in the sale of the property
and determine their authority to negotiate and make counteroffers.
Include in the process a complete review by the City Attorney of major documents.
Determine if the property will be listed with a real estate agent and how the agent will be
chosen.
Identify the physical condition of the property, including code violations, and which ones
should be corrected prior to resale.
Decide the method for determining the proposed sale price.
Identify who will be responsible for maintenance of the property until it is sold.
Establish timelines for the process including deadlines for receiving offers.
There may be other issues that the Council may wish to add to this list. Attached is a draft policy
resolution based upon these points for your consideration.

Policy for Sale of Residential Properties owned by the City
Whereas, the City of Plymouth purchased and resold seven homes as a part of the County
Road 101 improvement project during 2001 and 2002; and,
Whereas, the City does not routinely offer properties it acquires for re -sale; and,
Whereas, the Plymouth City Council finds it beneficial to use the experience gained in
the re -sale of these properties to establish policies to guide the future re -sale of residential
properties;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA THAT THE FOLLOWING POLICY BE ADOPTED
TO GUIDE THE FUTURE RE -SALE OF RESIDENTIAL PROPERTY IN THE CITY:
At or before the time of the public hearing required by the City Charter on the proposed
disposition of residential property to members of the general public, the City Council will
consider a procedural plan upon recommendation of staff addressing the following items:
1. Identify who is authorized to represent the City in the sale of the property and
their specific authority to negotiate or make counteroffers on behalf of the City.
2. Include a process for having the City Attorney review major documents before
presentation to the Council for approval.
3. Determine a process for hiring a real estate agent, if any.
4. Review a report by the City staff on the condition of the property, including any
violations of City Code, and recommendations on needed repairs before re -sale.
5. Identify how the proposed sale price will be determined and decided.
6. Designate a specific individual or party to provide for the maintenance of the
property until the property is sold.
7. Establish timelines for various aspects of the process, including any deadlines for
receiving offers.
The City Council may add to or amend any element of the procedural plan based upon
any specific facts and circumstances that may be present. This policy is intended as a
suggested guideline for consideration, and does not bind the City of Plymouth to any
specific actions in the future.

ACTION REQUESTED: Review the pending study session topics list and establish future
special meetings if desired. Calendars are attached to assist in scheduling.
The City Council previously scheduled discussion of the City's Weed Mowing and
Assessment Policy for November 19. We have learned that one of the residents interested in
discussing this issue with the Council cannot be present at this meeting. He has requested
that the meeting be deferred to a future date. The Council can either schedule an alternate
date for this item or put the item back on the pending study sessions list for action after the
first of the year. Due to its seasonal nature, there is no need for immediate action on this
item.
There is an item on the regular meeting agenda relating to the process for filling the
upcoming vacancy on the City Council. If the Council wishes to conduct interviews of
applicants, an interview date could be selected.
