RESOLUTION No. 2013-319
A RESOLUTION AUTHORIZING THE VACATION OF
DRAINAGE AND UTILITY EASEMENTS
WITHIN LOTS 1 AND 2, BLOCK 2, PLYMOUTH HILLS ADDITION
WHEREAS, a public hearing Nvith respect to said vacations Nvas scheduled for September 24,
2013, in accordance Nvith Minnesota Statutes 412.851 and City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing Nvas published and posted two Nveeks prior to
the meeting of September 24, 2013; and
WHEREAS, all property owners adjacent to the proposed vacation Nvere duly notified by mail;
and
WHEREAS, the City Council did hold a public hearing on September 24, 2013, to inform any
and all interested parties relevant to the vacation of drainage and utility easements Nvithin Lots 1 and 2,
Block 2, PIN -mouth Hills Addition; and
WHEREAS, it Nvas determined by the City Council that said easements are not needed for public
purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the drainage and utility easements within Lots 1 and 2, Block 2,
PIN -mouth Hills Addition described as follows, be vacated:
6 foot Nide drainage and utility easements Wring on the Nvest side of Lot 1, Block
2 and on the east side of Lot 2, Block 2, PIN -mouth Hills Addition and beginning
6 feet south of the north line and 6 feet north of the south line of said Lots 1 and
2, Block 2, PIN -mouth Hills Addition that Nvas described in recorded Document
Nos. 3593111 and 443 125 1.
FURTHER, that said vacations shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm
seNver lines, Nvater pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue
maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace,
remove, or othenvise attend thereof.
