Council meeting in City Council Chambers. This meeting will be
preceded by a study meeting commencing at 12 p.m. The location has
not yet been determined.
4. EMPLOYEE PICNIC -- Wednesday, July 19. The annual employee picnic
will be held at the French Regional Park - Skyview Picnic Area (new
shelters on the top of the hill to your rights as you enter the
park). If you and your family plan to attend, please let Laurie
know no later than Friday, June 30.
5. CALENDARS _-- Meeting calendars for June, July and August are
attached. The July calendar has been revised to show the addition
of a Council Study Session on Monday, July 10 at noon; and a Council
Study session on Tuesday, July 18 at 5 p.m. (M-5)
FOR YOUR INFORMATION.....
1. COMMUNITY CENTER - Eric and I have been meeting regularly with the
architects for the community center. They are continuing to refine
the schematic plans and in this regard, are working closely with
representatives of our construction management company, McGough
Construction. I am anticipating that the schematic drawings will be
completed, along with McGough's construction cost estimates, in
order that they can be provided to the Council prior to the
scheduled July 10 study meeting.

2. REGIONAL TRANSIT BOARD APPOINTMENTS - In my June 9 information
memorandum, I advised the Council that the Metropolitan Council is
soliciting applications from local elected officials who are
interested in serving on the reconstituted Regional Transit Board.
Legislation adopted this past session revised the Regional Transit
Board to be composed of between eight locally elected officials and
three individuals selected by the Governor. The local elected
officials are selected by the Metropolitan Council.
The inclusion of local elected officials on the new board is to
facilitate greater sensitivity on the part of the Regional Transit
Board to local transportation issues. As part of the legislation,
the Association of Metropolitan Municipalities is to provide a list
of least two candidates from each RTB district (shown on attached
map). At present, two local elected officials have expressed an
interest for District F, which includes Plymouth. They are Jan
Haugen, Mayor of Shorewood (see attached letter of recommendation
and resolution), and Patricia Pidcock, who is a councilmember from
the City of Eden Prairie.
The reconstituted Regional Transit Board will have a significant
impact on the future of transit, including light rail and perhaps
even roads and highways in the near future. Consequently, the
Council may wish to consider whether one of its members should
submit an application for a Regional Transit Board position. I have
obtained application forms which must be filled out by Monday, June
26. The appointment process requires that a completed application
be submitted to the Secretary of State and a letter sent to AMM
indicating interest. A series of public meetings are then held by
the Metropolitan Council to hear statements from the candidates.
For the district including Plymouth, the public hearing is on July
20 at 7 p.m. in the Champlin City Council Chambers, 11955 Champlin
Drive. The Metropolitan Council is to select its eight RTB members
by August 1.
If Councilmembers are not interested, consideration should be given
to endorse Mayor Jan Haugan's candidacy as requested in her letter.

5. WEST SUBURBAN MEDIATION CENTER -- Attached is information concerning
the West Suburban Mediation Center. This is the mediation service
which Herb's Service Station and Mary Schlender of Kimberly Meadows
will use to resolve noise problems. (I-5)
6. COURTESY BENCHES (BUS BENCHES) -- Attached is a copy of the Courtesy
Bench Permit Application. Fifty copies were sent to Rollie
Danielson, U.S. Bench Corporation, along with a copy of the
ordinance regulating courtesy benches which was recently adopted by
the Council. (I-6)
7. CHANGE IN HOURS OF SALE FOR OFF -SALE LIQUOR STORES -- Effective
April 29, the Legislature changed the hours of sale effecting
off -sale establishments. Sales may now be made on July 4th and New
Years Day. Also, the day preceding these two holidays, sales may
still be made until 10 p.m. Additionally, on -sale liquor
establishments will be allowed to serve until 1 a.m. on Mondays.
Attached is a memorandum from Richard Carlquist, letter from City
Attorney and copy of amendments. (I-7)
S. DISMISSAL OF COMPLAINT - Attached is a Stipulation Dismissing
Complaint Against Defendant City of Plymouth concerning Albrecht v.
City of Plymouth. Also attached are letters from James J. Thomson,
City Attorney and Medard B. Kaisershot, Attorney. (I-8)
9. METROPOLITAN COUNCIL - The Metropolitan Council will be appointing
18 people to its Land Use Advisory Committee (LUAC) this summer.
Attached is a letter from Steve Keefe, Chair, asking for
participation and assistance in selecting members for the LUAC.

REGIONAL TRANSIT BOARD (RTB) NOMINATIONS.
Recent legislation reorganizing the Reg.i9.mal_.-TTransit
___provides that of the-mew-ev�� me`mber board, eight
appointe bd y the Metropolitan Council one each from
various council districts per the enclosed map. Of

AMM are required to provide the Metropolitan Council with at
least two nominations for each position.
This is a significant change from past philosophy. Recent AMM
policy called for elected official direct participation on
the Regional Transit Board. Legislators, including the
principal authors, were concerned about the dedication and
commitment of time by elected officials and only after several
strong assurances by AMM staff did they in fact establisn an
RTB with a majority of elected officials.
The new RTB in addition to its previous tasks and duties, has
regional planning and approval authority over LRT. Its
responsibilities will include coordination of all transit,
approval of LRT Grants, study and provision of increased
suburban transit opportunity and overseeing a new LRT planning
advisory group.
A position on this new board will be challenging and will
require a commitment on the part of those serving to be active
participants. RTB members receive $50 per meeting not to
exceed $50 per day and parking and travel expenses. The
current board meets twice a month late Monday afternoon with
subcommittee meetings following. However, meeting day, time
and frequency will be at the discretion of the new board. The
AMM board must make nominations to the Metropolitan Council
by the last week of June.

RE: Appointment to the Regional Transit Board
I would like to be nominated for the vacancy on the Regional Tran-
sit Board. I believe my approach would assure that all aspects of
transportation planning are considered when working for solutions
to Regional transportation issues.
I have been active in transportation issues, including the RTB
Chairman's Advisory Board, the AMM Transportation Committee, the
Hennepin County Light Rail Advisory Committee, and as a member
of the Shorewood City Council since 1976.
I have served on the City Council since 1976 - and as Mayor since
January 1, 1989.
I served on the Light Rail Advisory Committee for the S.W. Area
since 1976.
I have been on the Board of Directors of the AMM and served on the
Revenue and Transportation and Metropolitan Issues committees.
I have served on numerous League of Cities committees, was a founder
and President of the Women in Government, served on the first Board
of the Women Elected Officials of Minnesota, and a Metropolitan Council
committee.
I believe the RTB ought to be the "transportation" advisory board
and take all modes of transportation and all means of dealing with
transportation problems into account. My experience Ln highway,
light rail, transit and transportation planning issues would be of
great benefit to the Board. I seek coordination of transportation -
not duplication.

A RESOLUTION SUPPORTING AND RECOMMENDING JAN HAUGEN
MAYOR, CITY OF SHOREWOOD, FOR THE OPENING IN AREA F
ON THE REGIONAL TRANSIT BOARD
WHEREAS, Jan Haugen, Mayor, City of Shorewood, has served on the
City Council of the City of Shorewood since 1976; and,
WHEREAS, Jan Haugen has been involved in transit and transportation
planning issues as a member of the City Council and as Mayor since 1976;
and,
WHEREAS, Jan Haugen has served on the RTB Chairman's Advisory
Board; and,
WHEREAS, Jan Haugen has served on the AMR Board and its Revenue and
Transportation committees; and,
WHEREAS, Jan Haugen has served on the Hennepin County Light Rail
Advisory committee for the S.W. Area since 1976; and,
WHEREAS, Jan Haugen has been involved in County, Metropolitan, and
State organizations as a founder and president of the Women in Government,
and as a founder and Board member of Women Elected Officials of Minnesota,
and on numerous League of Cities and Metropolitan Council committees; and,
WHEREAS, Jan Haugen will consider all aspects of transportation in
transit planning.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Shorewood,
THAT, the City Council of the City of Shorewood recommends Jan Haugen
for the vacancy on the Regional Transit Board; and,
THAT, the City Council of the City of Shorewood supports the nomination
of Jan Haugen for the vacancy on the Regional Transit Board throughout the
selection process.

MAY 24, 1989
The Regular Meeting of the Plymouth Planning Commission was
called to order at 7:30 P.M. by Chairman Richard Plufka.
MEMBERS PRESENT: Chairman Richard Plufka, Commissioners
Michael Stulberg, Dennis Zylla, Larry
Marofsky, Hal Pierce, Joy Tierney and
John Wire.
MEMBERS ABSENT: None.

Chairman Plufka introduced the request of Craig Scherber for CRAIG SCHERBER. LAND USE
a Land Use Guide Plan Amendment, Rezoning and Preliminary GUIDE PLAN AMENDMENT/
Plat for a Conventional Residential Subdivision for Swan REZONING (89025)
Lake West located north of County Road 9 and east of West
Medicine Lake Drive.
Coordinator Dillerud gave an overview of the Staff Report of
May 17, 1989.
Chairman Plufka introduced Mr. Tom Loucks representing the
petitioner.
Mr. Loucks introduced Mr. David Putnam the project engineer
of the project.
Mr. Loucks stated that he felt that the development should
be assessed as a single family development and not as stated
in #1 of the Engineer's Memo regarding assessment.
Chairman Plufka stated that the Planning Commission does not
handle assessments and that this is something the City
Council will deal with.
Mr. Loucks stated that he did not agree with item 8 of the
Preliminary Plat Resolution regarding the park dedication.
He stated that the Parks and Recreation Advisory Commission
on May 1, 1989 did not approve the recommendation made by
Parks Director Eric Blank He said that he was in
attendance at the meeting.
Discussion followed on the subject of increasing the park
width from 50 feet to 100 feet along the west shore of Swan
Lake.

Mr. Gruenke stated that he felt the increase in the width of
the area from 100 feet from 50 feet around the lake would
destroy •many of the trees. He stated that the area had
steep banks and that nothing would be gained by the
increase.
Chairman Plufka introduced Mr. Patrick Kraft of 4345 Oakview
Lane.
Mr. Kraft stated that he felt a 50 foot path was not wide
enough and that the developer should be made to redesign the
plans to allow for a 100 foot path. Mr. Kraft stated that
he thought the Parks and Recreation Department had planned
for many years to have a park around the lake.
Chairman Plufka introduced Mr. Brian Sand of 4325 Oakview
Lane.
Mr. Sand stated that he felt a road connecting Quinwood Lane
to 44th Avenue North would be a mistake and a traffic hazard
but he would like to see the development redesigned to allow
for a 100 foot park area around the west side of the lake.
Chairman Plufka introduced Mr. Mark Byington of 4495
Quinwood Lane.
Mr. Byington stated he favored a turn around on Quinwood
Lane instead of a thru street. He stated that the steep
grade of the area would present a problem for a road.
Mr. Sand indicated that he had always understood the area
around the lake was to be a neighborhood park with no
parking area.
Chairman Plufka closed the Public Hearing.

Stulberg to combine approval for the Land Use Guide Plan
Amendment and the Staged Growth Element Amendment and to
recommend approval of both.

Commissioner Wire stated that the Parks and Recreation
Advisory Committee Minutes do not give any plans for access
to the park. He indicated that it seemed difficult to see
an access point to the park from Quinwood Lane or from the
south.
Mr. Putnam discussed the steep banks of the area and the
petitioner's grading plans.
Mr. Loucks stated that access to a neighborhood park is
normally walk-in. He stated that the Parks Department

recommendation to have drive in access is inconsistent with
the neighborhood park concept.
Commissioner Zylla, who is the liaison for the Planning
Commission to the Parks and Recreation Advisory Committee,
stated that there is no present site plan in existence for a
park around the lake and that the City would have to
purchase additional land from the developer for a park.
Mr. Loucks indicated that if the petitioner added an
additional 50 feet of width to the proposed trail, they
would lose Lots #1, 7, 8, 9, and 10. The lots would be
substandard -in size yet the utilities would still have to be
installed.
MOTION by Commissioner Stulberg, seconded by Commissioner
Wire to recommend approval of the Preliminary Plat of Craig
Scherber for Swan Lake West including the conditions listed
in the Staff Report dated May 17, 1989, adding the statement
to condition #1 noting the developer's comment that
assessment should be for a single family development as
proposed, and not assessed based on the current guiding.

for a Land Use Guide Plan Amendment. He indicated this item
had been the subject of a Public Hearing held April 12,
1989, and that the Planning Commission had voted to defer
consideration of the matter until the first meeting after
the Public Hearing on the Land Use Guide Plan.

Commissioner Pierce indicated that he felt the CS guiding is
taking a different character than what previously existed.
Commissioner Marofsky stated that he believed retail

felt the site was better suited for CRS -1 guiding consistent
with the proposed Land Use Guide Plan Text.

to recommend approval of reguiding for C.G. Rein Company at
the southwest corner of State Highway 169 and Schmidt Lake
Road from CL (limited commercial) to CS (service business)
consistent with the terms and conditions contained in the
Staff Report dated April 12, 1989.

Commissioner Wire stated that it was his desire that the
petitioner be aware that the definition of CS is likely to
change with respect to the uses that are allowable during

Construction Company concerning "Rockford Plaza" was now (89014)

Commissioner Marofsky indicated that he would step down from
the table and not participate in the discussion or action
concerning this item.
Chairman Plufka introduced Bill McHale representing Ryan
Construction Company. Mr. McHale indicated that the seller
of the property, Jerome Begin, does not own the area of land
north of this site, as was claimed in the May 19 staff memo.
Because he does not own that area to the north, there were
not options available to expand the LA -3 guided parcel to
accommodate a more reasonable site design within the LA -3
guiding.
Mr. McHale indicated that the actual site that would be used
for neighborhood shopping purposes nets to 43 acres after
subtraction of roadway and ponding. He stated this 43 acres
is nearly identical to the approximate 42 acres that the
Land -Use Guide Plan provides for neighborhood shopping at
this location. He further indicated that the trade area for
the center would be to a large degree market driven but not
substantially inconsistent with service area intended for
the Plymouth Creek Driving Neighborhood.
Mr. McHale indicated that the uses that would be allowable
for CS guiding - an alternative that had been discussed for
this site - were not certain in the future, and therefore,
Ryan was not in a position that they would have comfort with
guiding any part of the site CS.
Mr. McHale then reviewed with the Commissioners, with the
aid of graphics, the several natural site features that
existed that may be worthy of preservation. He noted that
he, at this point, could not see how any of the trees on the

consultant in their review of this project. He indicated
that this additional traffic study should be undertaken by
the developer for presentation to the Planning Commission at
the Preliminary Plat/Plan stage.
Commissioner~ Plufka then asked if other members of the
audience wished to address this item during the continued
Public Hearing.
Carolyn Luxmore, residing at the corner of 45th Avenue North
and West Medicine Lake Drive, indicated that she opposed the
proposed reguiding from the existing LA -3 to CN. She
indicated that the existing CN guiding of the site was
sufficient in scale to support a neighborhood shopping
center at this location.
Chairman Plufka then closed the Public Hearing.

to work with, and that by the inclusion of 10 more acres of
CN guiding it may be possible to guide sufficient area to

to recommend approval of the petition subject to the
conditions listed in the Revised Draft Resolution and the
Staff Report dated May 12, 1989.

Commissioner Stulberg stated that he wanted to clarify for
the record that the Planning Commission Subcommittee would
not have a report ready for the City Council on Residential
Care Facilities in May as was anticipated because of the

1. CALL TO ORDER
Acting Chair LaTour called the meeting to order at 7:38 p.m. in the
Council Conference Room.
2. APPROVAL OF MINUTES
A motion was made by Commissioner Freels and seconded by Commissioner
Beach to approve the minutes of the May meeting as presented. The motion
carried with all ayes.
3. VISITOR PRESENTATIONS
a. Athletic Associations. None were present at this meeting.
b. Staff. Staff was not present.
C. Others. There were no other visitors.
4. REPORT ON PAST COUNCIL ACTION
a. Mooney Lake Plat. Director Blank distributed a copy of the Mooney
Lake plat approved by the City Council. Lundgren Bros. has been
directed to build and pave a trail in Phase I of this development.
They will be dedicating less than 10% in park land and the remainder
of the dedication will come in the form of cash. Lundgren Bros. will
not be constructing an overlook as they once proposed. Lot 20 will
not be set aside as a preserve as recommended by the Planning
Commission and PRAC. It was the general consensus of the
commissioners present that the City Council did not act in the best
interests of the residents when they approved Lundgren Bros. plat by
allowing Lot 20 to be built on. The commissioners felt that the
Council ignored their recommendation for open space and a natural
preserve area. Commissioner Rosen stated that PRAC needs to be more
aggressive in the future with their recommendations, so that the
Council gets a very clear message about the recommendations PRAC
makes. He suggested that maybe more joint meetings need to be held,
or that the commissioner(s) attending the Council meetings need to
speak out more. The other commissioners agreed with this.
5. UNFINISHED BUSINESS
a. West Medicine Lake Drive Trail Update. The consultant and staff held
a special meeting with residents in May. The final construction
report on this project will be going to the City Council in June. The
consultant has stated that this project will take about two weeks to
complete and should be finished in 1989.

b. Plymouth Creek Parking Lot Expansion. The contractor is a little
behind on this project, but the parking lot should be ready by June
16.
c. Comprehensive Plan - Review and Discuss. A public hearing will be
scheduled for July or August regarding the parks component of the
Comprehensive Plan. Notices will be published in local newspapers and
any affected residents will receive letters inviting them to attend.
Director Blank discussed the park issues of the comprehensive plan,
explaining how some proposed parks are changing in location and/or
shape. He stated that the plan will show the land we own around Mud
Lake and the playfield will be moved up next to the neighborhood park.
Forster's Meats owns a piece of property adjacent to Zachary Playfield
that the City would like to get in exchange for some property that we
own south of County Road 9. A larger area is being proposed for the
Fernbrook/County Road 9 neighborhood park that will give us more
trees. The plan shows that more land should be acquired north of
Plymouth Creek Park. The neighborhood park proposed for the area near
24 and 101 is being moved slightly to show it on three different
parcels. This will help with future park dedication requirements.
The 50+ -acre site at old County Road 9 & Dunkirk Lane that was
proposed to be a junior high/elementary campus is currently guided
public/semi-public. This will be shown as a future community
playfield. If the area west of Hollydale Golf Course is re -guided,
Director Blank indicated that the proposed neighborhood park should be
moved in a northwesterly direction.
d. Community Center Update. Director Blank discussed the latest changes
to the proposed community center plans and shared new drawings with
the commissioners.
e. Swan Lake Plat Update. Director Blank indicated that the development
of the Swan Lake plat will be on the City Council agenda in late June
or early July. Commissioner Rosen stated he was concerned that the
motion he made at the May PRAC meeting did not address strongly enough
the need for access into the park from the north, or the need for
"open views" into the park. In addition to vehicular access, he feels
there should be more access for bikers, pedestrians, and people who
simply want to "look" into the park. Commissioner Freels agreed that
there had to be an access into the park from the north. The
commissioners feel that the plat should be redrawn to show the road
going through on the north end of the park.
A MOTION WAS MADE BY COMMISSIONER ROSEN AND SECONDED BY COMMISSIONER
FREELS TO DEFINE THE TRAIL CORRIDOR MORE SPECIFICALLY TO BE A 75 FOOT
TRAIL CORRIDOR RATHER THAN 100 FEET, BUT ONLY IF THERE IS OTHER PUBLIC
ACCESS ON THE NORTH SIDE, SPECIFICALLY LOT #1 AS SHOWN ON THE SWAN
LAKE PLAT, AND/OR TO SHOW THE ROAD GOING THROUGH ON THE NORTH SIDE.
The motion carried with all ayes.
f. CIP 1990-94. Director Blank reviewed the 1989 Park Dedication Fund
balances estimating that the community parks/playfields account will
have a balance of $626,782 and the neighborhood parks account will

have a balance of $320,672 at the end of 1989. Projects proposed in
the CIP include the Plymouth Creek tennis courts in 1989 at an
estimated $211,000 for four courts; in 1990 projects include the Swan
Lake neighborhood park acquisition and development, the Bass Lake
playfield/neighborhood park, the Ridgemount playfield which involves
relocating and improving the softball fields and putting in a third
soccer field, acquisition of the playfield near Plymouth Creek
Elementary, and trail projects on 46th Avenue and West Medicine Lake
Drive; 1991 projects include the northeast neighborhood park
acquisition/development, the Parkers Lake playfield, improving the
Shiloh playground equipment, and trail; 1992 projects are the
Vicksburg/22nd Avenue neighborhood park, Fernbrook/County Road 9
neighborhood park, playfield acquisition, phase I of West Medicine
Lake park, Timber Shores parking lot, and trail on Zachary Lane; 1993
projects would be the Mud Lake neighborhood park, playfield
acquisition, phase II of West Medicine park, and replacement of
Gleanloch playground equipment; 1994 projects include the 101/24
neighborhood park, playfield/neighborhood park land acquisition,
Parkers Lake group picnic grounds and trail. Items that have been
discussed that are not in the draft CIP include the Forsters property
west of Zachary, a permanent warming house/shelter for Ridgemount
Playfield, dredging of the pond in the Plymouth Creek Park (requiring
approval from the Corps of Engineers), a golf course, and more trails.
Director Blank stated that with the upgrading of Ridgemount and the
addition of the third soccer field at Plymouth Creek, it might be
possible to postpone the development of the playfields at Bass Lake or
Parkers Lake. Currently, the existing playfields stand unused on
weekends, and staff is considering asking the athletic associations to
start scheduling more games on Friday nights and Saturday mornings.
He also stated that if we add another adult softball league next
summer, it will be on Sunday night. Commissioner Rosen and Freels
agreed with staff regarding possibly postponing the development of new
playfields and encouraging the athletic associations to schedule more
activities on weekends.

AN ORDINANCE AMENDING A
PORTION OF THE ORDINANCE
819, ADOPTED JUNE 16, 1980, AS
AMENDED, AND KNOWN AS THE
PLYMOUTH ZONING ORDINANCE,
RELATIVE TO THE PROVISION
FOR PARTICIPATIVE ATHLETIC
USES IN THE 1-1 (PLANNED IN-
DUSTRIAL) DISTRICT.
THE CITY COUNCIL OF THE
CITY OF PLYMOUTH DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Section A, Subdivision B

Section 2. Section 8, bdivision C
(1) (f) is hereby amended to read as
follows:
Allow a limited amount of sere
vice/business uses, by conditional
use permit, which are either essen-
tial to or compatible with the
operation of the Planned Industrial
District or (and] which provide
essential services to employees
withinthedistrict.
Section 3. Section 8, Subdivision D
(2) is hereby amended by the addition
following:

property owner has demonstrated

We in Chelsea Mews Association need your help. A tarred bike trail
has been constructed in the Lundgren Bros. development called
Steeplechase. This bike trail begins at the turnaround of.their
Zanzibar Lane and ends at the edge of Chelsea Mews property on
North Zanzibar Lane. Between where the trail ends and the street
of Zanzibar there is a wooded hill. People from the Lundgren
development side have worn a path through the wooded area to gain
access to Zanzibar. The problem is that our homeowners on Zanzibar
are very concerned that they will run over the bikers using the
path. You can't see them until they are right in the street, and
they are going too fast down the hill to stop.
Chelsea Mews has never been consulted about the matter of the
location of the trail or even formally advised that the trail exists.
Chelsea Mews has no money reserved for completing such a trail.
Besides, our Zanzibar homeowners do not want it located where it
would be if it were simply extended. Considerable dollars would
have to be spent to make it safe (hill cut down, trees removed,
safety signs erected, etc.).
Could you please forward this letter to the appropriate persons and
ask that they contact me so we can figure out a course of action.

This letter is to formally advise you that the City of Plymouth will be
formally discontinuing Plymouth Metrolink's services and all Medicine Lake
Lines services within the City of Plymouth effective at 12 midnight
December 31, 1989. The purpose of this discontinuation is to allow the City
to prepare and solicit requests for proposals from public transit vendors to
provide this service for the next three years. It appears that the City of
Maple Grove will be included in the request for proposals and will be bid as
either part of, or a separate public transportation system.
I am providing you with this information for planning purposes. Because of
your company's experience in providing services both to Plymouth and Maple
Grove, I would expect that your company would be one of those submitting a
proposal for the service.
I am also providing this notice because of a comment you made during a
May 25, 1989 meeting between Medicine Lake Lines and City of Plymouth
representatives. You stated that Subdivision 2 of House File 1408A provides
that "the Regional Transit Board may provide financial assistance (whether
directly or through another entity) to private, for-profit operators of
public transit only for: (2) regular route services provided on the
effective date of this section, by a private for-profit operator under
contract with the board, or under certificate of convenience and necessity,

Your interpretation of this provision is that the legislation would preclude
the City of Plymouth from requesting proposals for service since Medicine
Lake Lines currently hold a certificate of convenience and necessity for
routes and streets within the City of Plymouth. On this basis, you maintain
that Medicine Lake Lines has an exclusive franchise from the City
effectively barring us from requesting proposals.

Twin Cities Area's Transit Operater Dispute Resolution Process
The transit operator dispute resolution process has been developed to afford
all transit operators, public or private, profit or non-profit, an opportunity
to appeal decisions or actions regarding public transit service provision made
by transit operators, the Regional Transit Board (RTB), or other transit
providers under contract to the RTB. The following describes the steps in the
process, and page 3 is a flow chart depicting the process.
General Process
Steo
A Complainant shall request review of issue by filing a written
objection to decision or action with the party that took the
aggrieved action within 7 days. This written objection should clearly
identify major items of contention and suggest alternative decisions
or actions and rationale for them. Copies of written objection shall
be sent to the Providers Advisory Committee Chair, RTB's Director of
Planning and Programs, and the Metropolitan Council's Transportation
Division Manager.
B Rcsoondent shall meet with Complainant within 14 days of receiving the
written objection to discuss the issue. I: the aggrieved action was
not taken by the RTB, then RTB staff shall be present to facilitate
discussion and to act as a resource.
C Respondent shall make a decision and issue a written response to
Complainant within 28 days of receiving the written objection! This
response shall include rationale for the initial decision and
subsequent or future action taken with regard to the issue under
objection. Copies of the response shall be sent to the Providers
Advisory Committee Chair, the RTB's Director of Planning and Programs,
and the Council's Transportation.Division Manager.
D If Complainant is not satisfied with response, Complainant may request
a hearing before the Transit Operator Dispute Resolution Board by
contacting the Council's Transportation Division Manager within 7 days
of Respondent's decision. The Request shall be accompanied by a
documentation of the original written objection and a summary of the
meetings/discussions with respondent and the RTB, and the basis of
dissatisfaction with the action taken to date. Copies shall be sent
to the RTB's Director of Planning and Programs and to the
Provider's Advisory Committee Chair.
The Council Chair shall appoint the Transit Operator Dispute Resolution
Board (DRB) as follows: 1 Council member, 1 RTB member, 2 PAC members
not directly affected by dispute, and 1 TAB member who will be chair.
(DRB membership shall be appointed on a case-by-case basis,
as written Requests for Dispute Resolution arise.)

E The DRB shall meet with Complainant and Respondent within 14 days of
receiving a request for a Dispute Resolution Board hearing. The
Council will staff the DRB, with RTB staff serving as a resource. The
DRB will hear views on the issue from both the Complainant and
Respondent.
F Council staff will prepare a draft report of the DRB's findings and
recommendations based on the hearing discussion. This report will
be reviewed and action taken by the DRB within 14 days of the hearing.
DRB recommendations will be forwarded to the RTB Chair immediately
upon action. Copies of the DRB's recommendations shall be sent to
all affected parties.
G RTB shall act on the DRB recommendations within 21 days of DRB action.
This completes the local process.
Steps A through C described above allow for possible resolution of disputes
between Respondent and Complainant. If the Complainant, after going through
those steps, still is unsatisfied with the resolution, the Complainant
should file a Request for Dispute Resolution with.the Council to be heard by
the Transit Provider Dispute Resolution Board ("DRB). The DRB's recommendations
will be forwarded to the RTB for consideration and action.
