4. BOARD OF REVIEW -- Tuesday, June 2, 7:30 p.m. The Council will
convene as the City's Board of Review in the Council Chambers.
5. COUNCIL & HENNEPIN COUNTY COMMISSIONERS MEETING -- Monday, June 8,
:30 p.m. The Council will meet with Hennepin County Commissioners
for the purpose of discussing the Hennepin County staff's report on
alternative sites for solid waste transfer stations. A copy of the
letter inviting Hennepin County Commissioners to the June 8 meeting
is attached. (M-5)
6. MEETING REMINDERS:
a. Annual Meeting - Association of Metropolitan Municipalities --
The AMM annual dinner meeting will be held Thursday, May 28, at
the Robert Lee Restaurant, 2350 Palmer Drive, New Brighton.
b. Annual Meeting - League of Minnesota Cities -- The 1987 LMC
annual conference will be held at the Mayor Civic Center in
Rochester, from June 9-12.

FOR YOUR INFORMATION......
1. FINAL 1987 TAX BILL -- Bob Renner of the MLC has provided me with a
copy of the estimated 1988 property tax impact based upon the
provisions that were contained in the 1987 Omnibus Tax Bill. These
data are currently aggregated by region and are not specific to each
city. The House Research Department is currently in the process of
developing a computer run for each of our MLC cities. When this
information is available, I will share it with the Council.
The bottom line is, of course, that while Plymouth is in the metro
suburbs west area, our average home value is substantially greater
than the $90,900 used in the attached example. You will note in the
data sheet that the taconite cities will be receiving a 14.8%
decrease in their net property tax for 1988. This actually
translates into a $25 per year reduction in their property taxes.
The " onerous' tax burden currently borne by those folks amounts to
$174 a year! In the west metro suburban area, however, the property
taxes are estimated to go up $128 for the average homestead or
10.2%. It absolutely defies logic and reason that intelligent
people can come to a conclusion that typical residential property
owners in the western suburban community should have a property tax
burden greater than nine times that of the similarly situated
residential homeowners in the taconite area. Even if the outstate
(non -metro) area is used, the property tax burden is more than three
and one-half times greater in the western suburban area than it is
outstate. Yet, this is the tax bill which the Governor and the DFL
leaders in the House and Senate proclaim as embodying meaningful and
far-reaching tax reform. I continue to believe that it demonstrates
their continuing " rapacious appetite for property expropriation'
(RAPE) of the metropolitan area. (I-1)
2. HONEYWELL AVIONICS FACILTY -- This past Monday I received a
telephone call from a Honeywell Avionics employee residing in
Plymouth. He informed me that his division, currently located in
St. Louis Park, was in the process of looking for a new site. The
division employs approximately 800 people and is looking for a
160,000 sq. ft. facility. According to information this individual
received, two sites were being looked at; one in Plymouth (the
Tennant site), and the second in Coon Rapids. Apparently, one of
the individuals responsible for site selection within the Honeywell
organization had circulated a memo to the employees indicating that
the Coon Rapids site appeared to have the edge as that community
appeared to be more interested in having Honeywell locate there than
was Plymouth, and further that they were prepared to offer certain
incentives.
On Tuesday, I tried to reach Mr. Dayton Anderson at Honeywell, who
Is the individual responsible for the site selection. I also
received a call on Tuesday from Councilmember Sisk who had heard
from another Plymouth resident and Honeywell employee who had read

the same memo and expressed his concern. On Wednesday, Mr. Anderson
and I did have an opportunity to visit about the matter. Honeywell
has apparently been looking at the two sites. They were workina
with Opus in considering a portion of the Tennant Company site and
with some other developer with regard to a Coon Rapids site. Mr.
Anderson indicated that the officials in Coon Rapids were very
interested in having Honeywell in their community and had offered
certain " concession S" regarding local property taxes as well as
providing some unspecified day care services. Mr. Anderson
indicated they had pretty well settled on the Coon Rapids site as it
appeared to be more attractive economically.
Both Blair and Fred have met during the past several weeks with Opus
Development people regarding possible development on the Tennant
site. They were asked by Opus representatives to keep the Honeywell
name confidential. No Honeywell employee attended these meetings or
contacted us while these discussions were being held. And no
mention of the need for " concessiont' was made other than the need
to occupy the new facility in February.
3. MEETING WITH PETE MEYER -- Mayor Schneider asked me to inform
ouncilmembers that he has been in touch with Pete Meyer with regard
to seeking his services in an effort to assist the Council in
improving the Job description/performance evaluation criteria for
the City Manager's position. Pete has recommended to the Mayor that
he, the Mayor, and I meet initially to try to scope the subject and
then subsequently meet with all Councilmembers. The Mayor informs
me that he has scheduled a meeting at Pete Meyer's office on dune

and be more economical for the City.
4. ELM CREEK WATER MANAGEMENT PLAN -- The Metropolitan Council has
completed its review of the Elm Creek Watershed Management Plan.
The Council has determined that the Elm Creek watershed plan is
consistent with the metropolitan system plans and will not cause any
amendment to local city comprehensive plans. The management plan
for the Bassett Creek Watershed has been submitted for Metropolitan
Council review. The Shingle Creek plan has not yet been completed.
5. RUTH BROWN - RESIGNATION -- Ruth Brown, Recreation Specialist, has
tendered her resignation effective Friday, May 29. Ruth started
with the City full-time in 1984. Prior to that time, she worked six
months on a part-time basis. Her primary responsibilities with the
City have included our beach program, swimming lessons, youth
soccer, children's programming and special events. She has proven
to be a very talented individual and will be a tough person to
replace. Ruth has agreed to continue to work part-time for us until
we have found and adequately trained a replacement to ensure the
high quality that we need at our beaches and summer swimming
programs. Ruth is leaving to begin a private consultinq business
dealing in the area of aquatics. We have already begun the process
of advertising for this position and are hopeful we can have a
replacement by dune 20.

6. 1987 VALUATION NOTICES -- 1987 valuation notices are being mailed
today to all Plymouth property owners. The valuation notices convey
the City Assessor's 1987 estimated market value and further notify
the property owner that the local Board of Review will be meeting on
June 2. These values are a result of our recently completed 1987
assessment. Due to market changes and inflation most residential
values in the City have been increased approximately 6%.
The following is a listing demonstrating the changes in values by
property type when comparing the 1986 to the 1987 assessment:

Permalease 0% to + 3.5%
Condominiums 0% to - 10%
Apartments + 6.5%

Exceptions to the above changes in market values would include new
construction, quartile, reappraisal, and/or other market adjust-
ments.
7. AREA 6 TOWN MEETING - RESIDENT FEEDBACK FORMS -- We received the
attached four resident feedback forms from the May 11 Town Meeting
earlier this week. The Council will be provided with copies of
staff responses as they are completed. (I-7)
8. GOLDEN VALLEY REFERENDUM -- On Tuesday, May 12 Golden Valley voters
defeated by a million bond proposal for a multi -use
recreational facility and swimming pool. Attached is an article
from the May 21 issue of the Golden Valley Post on the results of
the election. (I-8)
9. 1987 NOMINATIONS FOR LMC BOARD OF DIRECTORS AND OFFICERS -- Attached
is a May 14, 1987 memorandum from the League of Minnesota Cities
requesting the names of elected or appointed officials who would be
interested in serving on the League of Minnesota Cities Board of
Directors and Officers. If any member of the Council is interested
in being considered as a candidate for the Board of Directors, or
submitting the name of another city official, please let me know and
I will advise the League. (I-9)
10. CORRESPONDENCE:
a. Correspondence from Leonard and Marian Larson, 1940 E. Medicine
Lake Blvd., stating concerns with the operation and apparent
expansion of Harty's Boat Rental. Also attached is a letter
from Frank Boyles responding to Mr. and Mrs. Larson. In
addition, copies of the letters together with the City's

for information purposes. However, the letters provided to

RE: HENNEPIN COUNTY SOLID WASTE TRANSFER STATION ALTERNATIVES REPORT
Dear Commissioner Andrew:
I recently had the opportunity of meeting with representatives of the County staff
and your solid waste consultants to discuss a May 11 report dealing with potential
alternative sites for solid waste transfer stations. The site preferred by the
staff is located at the intersection of County Road 6 and I-494 in Plymouth.
The City Council has briefly reviewed this report and the potential need for a solid
waste transfering station in western Hennepin County. While it's fair to conclude
that the City Council's initial reaction to the report is not one of endorsement,
they do want to become more conversant with the issue and particularly, the County
Board's thinking with respect to the need for a site in this area.
Mayor Schneider and the Council would appreciate having the opportunity of meetinq
with you and your fellow commissioners here at the Plymouth City Center at 5:30 p.m.
on Monday, June 8 for approximately 1 to 1-1/2 hours to review this subject. We
will provide a light supper.
Plymouth is working diligently to attempt to meet its solid waste recycling goals
and further recognizes the need to be a participating part of the solid waste
solution in Hennepin County. We believe, therefore, that a joint meeting on June 8
will be mutually productive. We look forward to meeting with you and your fellow
commissioners on June 8.

SUBJECT: 1987 Nominations for the Board of Directors and Officers
On behalf of the nominating committee I would like to request your advice
in proposing candidates for the Board of Directors for the League of
Minnesota Cities.
Board positions that expire in ,June 1987 are: Mayor Kelly Ferber, Fergus
Falls; Mayor Duane Knutson, Fertile; Mayor Bob Benke, New Brighton, the
term of Mayor Connie Morrison now held by Liz Witt, Councilmember, Mendota
Heights.
The officers of the League of Minnesota Cities, the president and vice
president are elected annually.
The nominating committee will work with the guidelines for board
representation, which were developed as a result of the deliberations of
past nominating committees. Those guidelines appear on page 2 as well as a
listing of nominating committee members. Enclosed also is a listing of the
present board members and officers of the League.
We are asking for your help in putting forth candidates for board of
directors and officers. Tf you know of a city official who would be
considered for nomination, please give his or her name and a brief resume
of qualifications to Helen Schendel, Associate Director or to a member of
the nominating committee.
Our goal is to make sure that any good candidate is considered. Whether or
not to let an individual know that you are submitting his or her name is,
of course, up to you. The nominating committee, however, makes it a
practice to confirm the fact that an individual is willing to serve before

1. Geographic and Population Size Representation
There has been a conscious effort to see that different parts of the
state are represented on the Board, as well as the different sizes of
cities that are among the League's constituency.
2. Twin Cities Area/Outstate Balance
While there are no specific seats on the Board reserved for Twin
Cities area or outstate members, it has been a consistent practice to
maintain a rough balance of Board members from those areas.
3. Elected/Appointed Balance
Traditionally both elected and appointed municipal officials have
participated in all aspects of the League's activities, including
membership in the Board of Directors. Although no specific number of
seats on the Board are reserved for elected as distinct from appointed
officials, it has been consistent practice to have a majority of the
Board composed of elected officials. Furthermore, there has been some
effort to provide an opportunity for a variety of appointed officials
(e.g., clerks, city managers, attorneys, assessors, etc.) to serve on
the Board.
4. Rotation of Membership
In view of the fact that the League has more than 770 member cities
any individual who serves a full term on the Board is not normally
considered for another Board term. However, persons with Board
experience are often considered as potential officers.

When our property was purchased in 1962, at 1940 E. Medicine Lake
Blvd., a public boat rental at the 1920 address had twelve rowboats
to rent which was a small business. There are now many dozen row-
boats, some of which are towed over from another location when the
need arises. There are several pontoon boats and many buoys set
out to anchor sailboats and speedboats. These buoys are at the 1920,
2040 and 2900 addresses on Medicine Lake Blvd. Please send us the
information as to when and why the City approved this enlargement
of Hartys' Boat Rental into a marina and how we can stop this grow-
ing business.
The City spent money to put in a walking path and it is blocked by
parked cars at the 1920 address so children and adults go out into
the busy street to get around these cars. Please keep this walking
path clear for everyones use so there will not be a terrible accident
at this location.
A month after Hartys' Boat Rental opened this year a satelite was
rented which is an eyesore to look at all summer. Before the sate -
lite was rented, with -in twenty minutes, two people tried to urinate
on our property. What types of business in Plymouth require a City
license and what toilet facilities must be provided?
A blacktop lake access was put in to assist Hartys' Bait Store with-
out notifying the neighbors. Please send a copy of the contract the
City has with this new lake access.
We expect prompt action on these complaints so that we may again enjoy
a quiet residential neighborhood.

Thank you for both your May 5 and May 18 letters with pictures. The letters
and pictures have helped me gain a greater appreciation for your concerns.
I have forwarded both letters and the pictures to the involved departments
for their information.
I have now received responses from the Director of Planning and Community
Development, City Clerk, and Director of Park and Recreation regarding your
May 5 letter. Attached is a copy of a memorandum from Community Development
Director Blair Tremere with respect to your question about the growth of the
Harty's Boat Rental. As you can see, the City Council's Resolution 84-875
made findings and established conditions regarding Harty's Boat Rental
designed to regulate its growth. Also attached is a memorandum dated
December 14, 1984 which provides an inventory of the equipment associated
with the Harty's operation. City representatives will visit the site during
the summer months to determine whether compliance with Resolution 84-875 is
taking place, as well as to verify a number of points in your May 18 letter.
Your second question was whether or not the no parking is being adequately
enforced. I have asked the Public Safety Director to reevaluate enforcement
efforts in this area. I have attached a copy of the agreement between the
City and Harty's to maintain a winter public access as you requested.
Your final question was about the type of licenses required for this
facility. There are no City -issued licenses either for the satellite toilet
facilities or the business. The only regulation on this " non-conforminq
usc' is discussed in detail in the memorandum from Blair Tremere and attach-
ments.
Some of the situations you describe can only be enforced with your help.
The parking, dog running loose, activities before 7:00 a.m., and similar
Issues should be dealt with by phoning 911. We will alert police officers
to these issues. If you believe it would be helpful, I would be glad to
arrange for a meeting with you, Harty and City representatives to further
discuss this matter. I think you should recognize that the City's objective
will be to gain compliance with Resolution 84-875 and with other City Code
provisions. It is not reasonable to expect the discontinuation of this
operation as you might ultimately desire.

This is in response to your May 11, 1987 memorandum regarding the letter from the
Larsons dated May 5, 1987. You asked that I provide information that would respond to
the Larsons' first paragraph and as to any other aspects from a zoning perspective.
The Larsons are concerned about the Harty Boat Rental operation.
I have attached for your use a copy of City Council Resolution 84-875 which made find-
ings and established conditions regarding the non -conforming commercial use known as
"Harty's Boat Rental"; attached to that is a copy of a December 14, 1987 inventory of
the Harty Boat Rental operation which was referenced as part of that Resolution.
There are no additional special permits or licenses from a zoning perspective. This
Resolution resulted after an extensive period of discussion and negotiation with Mr.
Tom Harty who is now deceased. This Resolution and the inventory have been filed at
Hennepin County and constitute a basis for acknowledging the degree of operation which
could legitimately continue as a non -conforming use.
The terms of the Resolution are very clear and expansion and enlargement of the opera-
tion is rigidly controlled.
I have also attached a map and several graphics which highlight the location of the two
sites which constitute the Harty Boat Rental operation.

City Shoreland Management Regulations, and other applicable regulations as administered
by the Department of Natural Resources (DNR) and the Hennepin County Sheriff's Water
Patrol;

2. Off-street parking facilities are provided as indicated on the plans staff dated
December 13, 1984, and as described in the staff memorandum dated December 14,
1984; the operation may involve the use of valet parking at peak times, and the
use of the yard area north of the dwelling at 2900 East Medicine Lake Blvd. at
peak times, provided said parking is not allowed to encroach upon neighboring
property, or the public roadways, and provided that the parking is limited to
vehicles belonging to Harty's Boat Rental customers. The parking shall be
contained within the areas delineated on the submitted plans.
3. The Harty's Boat Rental operation is a non -conforming commercial use of land in a
Residential Zoning District within the meaning and the requirements of the
Plymouth Zoning Ordinance. Any changes to the operation as defined in the
memorandum and plans described by this Resolution shall be subject to review and
approval by the City within the limitations of the Zoning Ordinance Non -Conforming
Use Standards.
4. Any proposed site modifications, physical alterations, or improvements, such as,
but not limited to paving, extension of dock piers, lifts, or the introduction of
or removal of buildings, shall be reviewed and approved by the City and shall be
subject to the applicable requirements of the Zoning Ordinance, and other codes
and regulations which may govern, such as Shoreland Management Regulations,
regulations of the Department of Natural Resources (DNR), and regulations of the
Hennepin County Sheriff's Water Patrol.
5. The operation is subject to all applicable zoning, traffic, and nuisance
regulations, and verified violation of said regulations shall serve as a basis for
re-evaluating the authorized scope of the Harty's Boat Rental operations.

INVENTORY OF MARTY BOAT RENTAL OPERATION (UPDATE)
This is an update to the October 5, 1984 memorandum which described the inventory of
the Harty Boat Rental Operation taken by Parks and Recreation Director Eric Blank and
me in October at 1920 and 2900 East Medicine Lake Blvd.
Since then, I have reviewed the status of the operations further with Mr. Harty and
with his retained engineer, Mr. Sohn Johnson who has prepared, among other things, site
plans for each location. These plans reflect the inventory and facility at this time.
The purpose of the inventory is to establish a base for the determination of the non-
conforming use status of the operation.
1920 East Medicine Lake Blvd.
This location is
divided
by the East
Medicine Lake Road roadway and the office and bait
shop are housed
in the
building on
the east side of the roadway. The boat rental
equipment is on
the west
side of the
roadway and consists of the following:
Storage for up to 20 fishing boats
12 Buoys for anchoring sailboats
A 100 ft. dock that includes berths for 3 pontoons
There is an unsurfaced parking area approximately 55 ft. by 100 ft. in dimension; cal-
culations indicate 19 cars could be parked in this area per Ordinance parking stan-
dards; up to 36 cars can be stored in this area utilizing a valet parking system.
The area west of the roadway includes a small shed used to store life jackets and gas
cans; includes a small trailer used to haul trash from the site; and it includes, on a
seasonal basis, a satellite portable toilet.
2900 East Medicine Lake Blvd.
This site is also divided by East Medicine Lake Blvd. and includes, on the east side
the residence now occupied by Mr. Harty. The yard area north of the residence is used,
in part, for the boat rental operation as follows:

Off season boat storage consisting of 3 pontoon boat which belong to Mr. Harty and
2 pontoon boats which are property of neighboring residents.
This area also serves as a parking overflow lot and is only used when needed. A
valet parking system is utilized and the unpaved area has been calculated to have a
capacity of up to 12 to 18 cars utilizing Ordinance parking standards; the valet
system would allow for an ultimate capacity of up to 55 cars.
The lower area, west of East Medicine Lake Blvd., is accessed by a paved driveway which
leads down to the shoreline area. This area includes the following:
Storage for up to 30 fishing boats.
Buoys for up to 27 sailboats.
23 boat lifts which are privately owned and in use for private watercraft.
2 100 ft. long docks each containing 10 slips for a total of 20 slips.
The lower area also include portable satellite toilet, a small used house trailer which
is used for the "headquarters" building for this site, and a small shed which is used
for miscellaneous storage.
The lower area is unsurfaced except for that portion tied to the access from Medicine
Lake Blvd. and the parking area has been calculated to have a capacity of up to 10 cars
within Ordinance standards or using valet parking system up to 26 cars.
This inventory has been verified against the plans from Mr. Sohn C. Johnson and has
been reviewed with Mr. Harty.

corporation ("City") and Mary Harty, of the County of
Hennepin, State of Minnesota, doing business as Harty's, Boat
Rental ("Harty"),
WITNESSETH:
WHEREAS, Harty owns and operates a business known as
"Harty's Boat Rental" which business is maintained and
operated on the shores of Medicine Lake opposite the prem-
ises identified and numbered as 1920/1930 East Medicine Lake
Boulevard in the City of Plymouth, Minnesota, and
WHEREAS, Harty has an access to the shoreline of
Medicine Lake from East Medicine Lake Boulevard, and
WHEREAS, the City desires to provide a public access to
Medicine Lake from East Medicine Lake Boulevard for persons
who desire to engaged in ice fishing, and
WHEREAS, Harty is agreeable that the City may use her
access as a public access for that limited purpose over and
across property on which her business is conducted,
NOW THEREFORE, it is agreed between the parties hereto
as follows:
1. The City shall, with Harty's permission, maintain
a public access from East Medicine Lake Boulevard to Medi-
cine Lake. Said access to be located directly in front of
the property numbered as 1920 East Medicine Lake Boulevard.
Maintenance of the access shall consist of the construction
of a paved rampway from East Medicine Lake Boulevard to
Medicine Lake. The rampway shall be constructed without
cost to Harty. Construction of said rampway will not vest
any rights of ownership in the City.
2. Said public access shall be for the exclusive use
of members of the public desiring to go upon the frozen
waters of Medicine Lake for the purpose of ice fishing and
activities related thereto and said access shall cease to be
regarded as a public access when the waters of said Medicine
Lake are no longer frozen over.
3. During the period when the waters of Medicine Lake
are frozen over, City agrees that it will keep the access
plowed clear of snow and will otherwise maintain said access
without any objection on the part of Harty to do so.

4. Harty agrees that during the period when such
access is deemed to be public, she will not interfere with
such access nor make any charges whatever for its use by
members of the public.
5. At the expiration of this Agreement as set out in
Paragraph 7. below, the City shall restore the access to the
condition in which it was at the time it was used as a
public access under this Agreement.
6. Harty agrees that she will indemnify the City and
hold it harmless from any claims or damages to persons or
property from any cause whatsoever arising out of the use of
such access by members of the public regardless of the time
of year when such damage may occur.
7. This Agreement shall run from the date hereof
until such date in the calendar year 1993 when the waters of
Medicine Lake are no longer frozen over, at which time this
Agreement shall expire and be of no further force and
effect. Provided, however, that the City and Harty may
renegotiate this Agreement for a longer period and under
such terms and conditions as may at such time seem appropri-
ate to each party.
8. This Agreement shall be binding upon the parties
thereto, their heirs, successors and assigns.
IN TESTIMONY WHEREOF, the parties have set their hands
the day and year first above written.

potential sites for a fourth solid waste transfer station in Hennepin County: In
the report prepared by the consultants to the County and their staff, they have
Identified a primary site in Plymouth at the northeast corner of County Road 6 and
I-494.
Attached is a memo which I prepared for the City Council along with the copy of the
May 11 report and a " generid' transfer station site plan. Of the six sites
evaluated, three are located in Plymouth. As noted above, the one at County Road 6
and I-494 is, in the County staff's opinion, clearly the best.
Their second choice would be the County Home school site located in south
Minnetonka. The site located on County Road 15 and I-494 (northeast quadrant) is
not suitable and I am confident will not receive any further consideration. The
Workhouse industrial park site focuses in on the industrial land that is currently
being developed by United Properties on the west side of Niagara Lane north of
County Road 6.
Of the three Plymouth sites, I believe the site at County Road 6 and I-494 is
clearly the best. We are not seeking a solid waste transfering facility and
obviously have some concerns about the potential of such a facility beinq located in
our community. At the Council's direction, I have corresponded with the County
commissioners inviting them to a meeting to discuss this matter with our City
Council early next month. Because of your company's extensive development in the
Carlson Center specifically, and throughout the community generally, I know you
would want to be informed about this development.

our driveway and woke up to find somebody tampering with our son's
car parked in our driveway at 3175 Walnut Grove Lane, Plymouth, MN.
After quickly calling 911, the Plymouth Police arrived in the dark-
ness and apprehended the four youths. Their car was parked up the
street and had not left the scene yet.

Because of your comments at the May 11 Town Meeting, I have taken steps to
deal with the problems you identified. At the meeting you expressed concern
about the parties and noise occurring in the Timber Shores park area late at
night, coupled with alcohol and drug usage and sales. Your concern is that
these activities would tend. to be carried over onto the trail which is to be
built as part of the Harrison Hills plat.
Because of your complaint, I have sent a letter to three residents livinq
directly adjacent to the Timber Shores Park. Two of these individuals live
in the northwest portion of the park, just adjacent to the lake. I live on
the southwest perimeter of the park, and the final individual lives on the
southeast next door to the tot lot. In my letter (attached) I have asked
each of them to be especially sensitive to the type of problems you have
identified. I have encouraged them to call 911 immediately to eliminate the
problems you have identified. I have also them to contact me so that I will
be aware of the situation. Only through our combined vigilance can we
eliminate any problem associated with the use of Timber Shores Park.

At our May 11 Town Meeting, a resident of the Harrison Hills area expressed
concern about loud parties involving alcohol and drugs occurring in the
Timber Shores park area. While I was somewhat surprised by the statements,
I believe that it is critical to identify whether such problems exist and,

Thank you for your recent letter expressing concern about sharing bike paths
with motorcycles and snowmobiles. Frankly, I couldn't agree with you more.
Our objective is to reserve bike paths for walking and bicycle traffic only.
Periodic surveys show again and again, that one of the most popular aspects
of Plymouth's recreation system is our trails. Plymouth is just over 35
square miles in size, featuring 23 miles of trails. It's virtually
Impossible for our Police Department to serve our population of 42,000 and
patrol the trails. That's where you come in.
We need our residents to help us in enforcing the use of the city trails.
There are a number of things that you could do to assist us. You might call
911 whenever you see a motorcycle or snowmobile on the trail. Since it is
likely that the snowmobile or motorcycle will be gone by the time the police
arrive, I would strongly encourage you to log the characteristics of the
motorcycle/ snowmobile and the driver so that you can report this infor-
mation to the police in as much detail as possible. You can also help by
identifying at what time of day or night the trails are used by motorcycles
or snowmobiles with regularity. If you can share this information with us
we will be better able to focus our enforcement efforts during the appro-
priate time. This will increase our ability to apprehend the offender.

We have been residents of Plymouth for 11 years. The
last year of which we have resided at 6105 Deerwood Lane.
At the base of the driveway to our home -is a very low
spot in the street which collects water and mud. In
order to enter our driveway we must drive through this
muddy water. It is a very irritating situation since
the sand and mud tracks into our driveway and garage.
At this time we are paying over $5,000 per year in real
estate taxes we feel this is completely unnecessary and
wish to ask your assistance in repairing this situation.
We had planned to bring this to your attention at
the town meeting an clay 11, but were unable to attend.

Dear Mr. Pouliot:
This letter is in response to our past phone conversations
wherein we discussed the possibility of the City of Plymouth
including Medicine Lake in Area 4 of Plymouth's curbside
pickup of recyclables. I have presented this concept to our full
City Council at our meeting held May 4, 1987, and a motion was
unanimously passed to accept your offer. Medicine Lake understands
that it will not be billed for this service, and also that it will
expect no payment for tonnage of recyclables. Medicine Lake further
understands that by participating in Plymouth's Curbside Recycling
Program it will meet the guidelines established by Hennepin County
to implement a source -separation recycling program by January 1, 1988.
We look forward to beginning the curbside pickups as soon as possible,
which will then continue on the 2nd and 4th Tuesdays of each month.

This letter will address concerns which you discussed with Jim Willis, City
Manager, on May 4. These items involve the berm along 6th Avenue and the
disposal of the City owned property on which the berm has been constructed.
The berm was constructed by the City at the request of the homeowners living
along Windemere Drive. The purpose of the berm was to provide screening to
6th Avenue. Before the construction of 6th Avenue there was no roadway at
this location, and there were also several trees within the area that had to
be removed for the construction -of the roadway.
In order to construct the berm at a minimal cost the City obtained free fill
material for the berm. This took a substantial amount of dirt because of the
height of the berm which was being requested. For this reason, and also
because of some drainage problems which had to be resolved, it took a two
year period to construct the berm. The final berm construction was completed
in the summer of 1987. We did seed the berm last September, but because of
the extremely dry fall followed by this dry spring the seed did not germinate
and grow. For this reason there is reseeding necessary along the West end of
the berm and also the East end of the berm adjacent to your property.
One of your concerns are the thistles or noxious weeks on the berm. Last
week the City sprayed the entire berm in order to kill the thistles. I
looked at the berm today with the Environmental Supervisor and the thistles
are showing very clear signs of curling up and dying. The Environmental
Supervisor feels that this spraying has killed a majority of the thistles,
but another spraying will be required this fall because of minor areas which
have probably been missed. The City will again spray the entire berm this
fall.
The reseeding of the berm cannot take place for at least seven days after the
spraying for the thistles. The City has hired a contractor and the reseeding
of the area will take place the last week of May. In order to ensure that
there is adequate water for seed growth, the contractor, which will be doing
the seeding, will also water the berm as necessary.

As you may be aware, the land area on which the berm is constructed has been
declared a natural area by the City. This was done at the request of the
property owners within this area. For this reason, no maintenance of this
area is required except for the killing of noxious weeds.
It is the intent of the City to deed the ownership for the land on which the
berm is constructed to the adjoining property owners. We are presently
working on a plan to divide the property into several parcels which coincide
with the lot lines of the adjoining properties. After this is completed, we
will have a meeting of all adjoining property owners to see if they are
willing to accept the division of the property as proposed. Conditions which
would be required for each property owner to agree to would be that the
additional parcel of land would be attached legally to their existing lot,
and therefore, they could not dispose of the land in the future without
receiving City approval. There would also be conditions attached that no
access would be permitted to 6th Avenue. If any property owner was not
willing to accept these conditions, we would propose that the land go to the
adjoining property owner, if they were agreeable to the conditions. You, as
an adjoining property owner, will be informed of the proposed division and
deeding of the land before it takes place.
We will proceed with the division of the land and meeting with the property
owners in order that this process can be completed by the end of this summer.
The seeding of the berm will be taking place within the next week in order
that this matter can be resolved in the very near future.
