VILLAGE COUNCIL OF
PLYMOUTH, MINNESOTA.
Pursuant to due call and notice thereof, a t**j~- special meeting of the
Village Council of the Village of Plymouth was held on the 1st day of
Ortnner , 19 69 , commencing at 7.30 o'clock P.M. at the Arktlkgle

The following members were present: mayor Hilde, Councilmen Hintz, Humphrey,
and Kindseth
the following members were absent: Councilman Johnson

adoption:
RESOLUTION No. 69-356
A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR,
13th AVENUE NORTH TO 26TH AVENUE NORTH
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing was held on the lst day of October , 1969
relating to Water Installation From 13th Avenue North to 26th Avenue North Project
469 -OB
and,
WHEREAS, all persons present desiring to be heard were heard and their objections,
if any, were noted
NOW, MU3WORE, BE IT HERESY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
PLYMOUTH, MINNESOTA, AS FOUAWS:
"1. The Village Clerk has, with the assistance of the Bonegtren 6 Aasociatea
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for water installation from
13th Avenue North to 26th Avenue North Project 469 -OB.
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of,land to be specially assessed
in the amount calculated against the eame,
2. Notice has been duly published as required by law that this council
would meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to any item thereof, and
nne objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in sEiid proposed assessment was and is specially benefited
by the construction of 13th Avenue North to 26th Avenue North water
installation Project #69 -OB
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
B. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clark and filed in his office and shall thereupon be
and constitute the special assessment for 13th Avenue North to 26th Avenue
North water installation Project X169 -OB
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of 8% percent per annum.
A. Such assessments shall be payable in 30 equal annual installments
payable on the 1st day of January in each year, beginning in the year
19_L, and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19 69 . To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin County a certified statement of the
amount of all of such unpaid assessments and the amount which will be
due thereon on the 1st day of January in each year."
The above motion was seconded by Councilman Kindseth and upon vote being
taken thereon, the following voted in favor thereof: mayor Ailde, Councilmen
Hintz, Humphrey and Kindseth

Whereupon said resolution was declared duly passed and adopted.

I, the undersigned, being the duly qualified and acting Clerk-
Aw.-Inistrator of the Village of Plymouth, Minnesota, hereby certify
that I have carefully compared the attached and foregoing extract
of the minutes of a special meeting of the Village Council of said
Village held October 1, 1969, with the original thereof on file in
my office and the same is a full, true and complete transcript
therefrom.
WITNESS, My hand officially as such Clerk -Administrator and the
corporate seal of the Village this 7th day of October, 1969.
