HomeMy WebLinkAboutCity Council Resolution 1992-825CITY OF PLYMOUTH RESOLUTION NO. 92-815 REIMBURSING DEVELOPER FOR REQUIRED TRAIL CONSTRUCTION TYRELL EIGHTH ADDITION (88136) WHEREAS, the City of Plymouth and Hans Hagen Homes, Inc. have entered into a development contract dated December 19, 1986 for the development of Tyrell Eighth Addition; and WHEREAS, as part of this development, the developer was required to construct a paved trail on an oatlot between Orchid Lane and Minnesota Lane from 46th Avenue North to Schmidt Lake Road; and WHEREAS, the developer has completed the required trail construction in accordance with the approved plans and specifications and on the approved alignment; and WHEREAS, the City has accepted the trail for continuous maintenance on October 15, 1990 per Resolution No. 90-696; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required trail construction as provided for in the development contract; and WHEREAS, this amounts to $6,151.16 including engineering fees. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Hans Hagen Homes, Inc. is to be reimbursed in the amount of $6,151.16 for the required trail construction based on the alignment in the construction plans and in accordance with Section 13.1 in the development contract. BE IT FURTHER RESOLVED that the funds be allocated from the Park Dedication Fund. Adopted by the City Council on December 21, 1992.```' 0
