RESOLUTION 92-761
APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL
USE PERMIT FOR THOMAS BUCHANAN LOCATED AT 13305 -57TH AVENUE NORTH (92103)
WHEREAS, Thomas Buchanan has requested approval of an Amended Planned Unit
Development Plan and Conditional Use Permit for property located at 13305 -57th
Avenue North to allow for a reduced setback from 10 feet to 5 feet for
construction of a deck; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Thomas Buchanan for an Amended Planned Unit Development Plan and Conditional
Use Permit to allow reduced setbacks for property located at 13305 -57th Avenue
North, subject to the following conditions:
1. No other amendments or variances are granted or implied.
2. All applicable requirements of the City and State Building Codes shall be
implemented and enforced; no Code requirements are waived by this
approval.
3. The granting of the permit is responsive to criteria of the Zoning
Ordinance for Conditional Use Permits and PUD Plans.
4. The deck shall be set back 5 feet from the side property line.
