HomeMy WebLinkAboutCity Council Resolution 1992-733CITY OF PLYMOUTH RESOLUTION NO. 92- -3 WAIVER OF SUBDIVISION REQUIREMENT THAT PART OF THE SOUTH 6.15 FEET OF THE NORTH 649.65 FEET OF THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 WHICH LIES BETWEEN THE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 1, BLOCK 2, CREEKWOOD HILLS AND A LINE DRAWN SOUTHERLY MEASURED AT RIGHT ANGLES FROM THE SOUTH LINE OF SAID BLOCK 2 FROM THE MOST EASTERLY CORNER OF SAID LOT 1. WHEREAS, the City of Plymouth is the owner of the following described property: THAT PART OF THE SOUTH 6.15 FEET OF THE NORTH 649.65 FEET OF THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 11, TOWNSHIP 118, RANGE 22 WHICH LIES BETWEEN THE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 1, BLOCK 2, CREEKWOOD HILLS AND A LINE DRAWN SOUTHERLY MEASURED AT RIGHT ANGLES FROM THE SOUTH LINE OF SAID BLOCK 2 FROM THE MOST EASTERLY CORNER OF SAID LOT 1 (the "City Parcel"); and WHEREAS, the City has offered to convey said City Parcel to the adjacent property owner to the north who did not accept the offer; and WHEREAS, the property owners to the south of the City Parcel, Lee M. and Kathy L. Rainey and Hollis P. and Mary Jo Hinnekamp have offered to acquire the portions of the City Parcel adjacent to their respective properties; and WHEREAS, conveyance of the City Parcel to Lee M. and Kathy L. Rainey and to Hollis P. and Mary Jo Hinnekamp by a split in the legal description is not allowed under the City's subdivision regulations unless compliance with the restrictions is waived by the City; and WHEREAS, compliance with the subdivision restrictions will create an unnecessary hardship and failure to comply in this case does not interfere with the purpose of the subdivision regulations. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: I. That conveyance of the City Parcel by the following legal descriptions is hereby approved: Tract A: THAT PART OF THE SOUTH 6.15 FEET OF THE NORTH 649.65 FEET OF THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 11, TOWNSHIP 118, RANGE 22 WHICH LIES BETWEEN THE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 1, BLOCK 2, CREEKWOOD RF.SOLITI'IO\ `:0. 9'--iS HILLS AND THE NORTHERLY EXTENSION OF THE EAST LINE OF LOT 1, BLOCK 4, EVONNES LAKEVIEW ADDITION. and Tract B: THAT PART OF THE SOUTH 6.15 FEET OF THE NORTH 649.65 FEET OF THE NORTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 11, TOWNSHIP 118, RANGE 22 WHICH LIES BETWEEN THE NORTHERLY EXTENSION OF THE EAST LINE OF LOT 1, BLOCK 4, EVONNES LAKEVIEW ADDITION AND A LINE DRAWN SOUTHERLY NEASURED AT RIGHT ANGLES FROM THE SOUTH LINE OF BLOCK 2 CREEKWOOD HILLS FROM THE MOST EASTERLY CORNER OF LOT 1, BLOCK 2 CREEKWOOD HILLS. 2. That the City Clerk is directed to file a certified copy of this resolution with the Hennepin County Registrar of Titles. Adopted by the City Council on November 16 , 1992.
