HomeMy WebLinkAboutCity Council Resolution 1992-695CITY OF PLYMOUTH RESOLUTION NO. 92-695 REIMBURSING DEVELOPER FOR REQUIRED WATERMAIN CONSTRUCTION BASS LAKE TERRACE 2ND ADDITION (91070) WHEREAS, the City of Plymouth and Vern Reynolds Construction Company, Inc. have entered into a development contract dated December 16, 1991 and executed May 21, 1992 for the development of Bass Lake Terrace 2nd Addition; and WHEREAS, as part of this development, the developer was required to construct a 12 inch watermain in the Bass Lake Terrace 2nd Addition in order to conform with the City of Plymouth's Water Distribution Plan; and WHEREAS, the developer installed the required 12 inch watermain in 55th Avenue North and to the westerly plat boundary within Bass Lake Terrace 2nd Addition; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required watermain construction as provided for in the development contract; and WHEREAS, this amounts to $14,520 including engineering fees. NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer. Vern Reynolds Construction Company, Inc.. is to be reimbursed in the amount of $14,520 for the required 12 inch watermain construction based on the alignment in the construction plans and in accordance with Section 3.3 in the development contract. BE IT FURTHER RESOLVED that the funds he allocated from the Trunk Water Fund. Adopted by the City Council on November 2. 1992
