RESOLUTION NO. 92-687
REQUEST FOR PAYMENT NO. 9 AND FINAL
NORTHCENTRAL TRUNK SANITARY SEWER - PHASE I
CITY PROJECT NO. 015
WHEREAS, the City of Plymouth as owner and Glendale Contracting, Inc., as
contractor, have entered into an agreement for Northcentral Trunk Sanitary
Sever - Phase I, City Project No. 015, said agreement being dated April
26, 1991; and
WHEREAS, Glendale Contracting, Inc. did not finish the project according
to the agreement; and
WHEREAS, Northdale Contracting Company, Hank Weidema Excavating, and Jim
Huffman Landscaping were hired to complete the project; and
WHEREAS, the Engineer has certified acceptance of the work and approval of
the final request for payment.
WHEREAS, a settlement agreement has been prepared by U.S.F. b G. between
them and the City and subsequently reviewed by the City Attorney.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $335,752. Four
change orders were approved in the amount of $72,028.41
and the value of the work to date is $407,780.41 and is
herewith approved. This project overran the contract
amount by $14,680.26 or 4.87%.
2. That the work performed by the contractors for
Northcentral Trunk Sanitary Sewer - Phase I
Improvements, and certified to the Council by the
engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions
of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work
after final payment.
3. Request for Payment No. 9 and Final in the amount of
$86,372.52 to Hank Weidema Excavating and $1,092 to Jim
Huffman Landscaping for Northcentral Trunk Sanitary
Sever - Phase I Improvements is hereby approved and the
City Finance Director is hereby authorized and directed
to pay the same forthwith.
4. That the Mayor is authorized to sign the agreement
between U.S.F. S G. and the City relating to the final
payment of the bonding company.
