HomeMy WebLinkAboutCity Council Resolution 1992-652CITY OF PLYMOUTH RESOLUTION 92-6S2 AUTHORIZING ABATEMENT OF VIOLATION OF CITY CODE SECTION 2010.01 (INTERSECTION SIGHT OBSTRUCTION) AT 18405 20TH AVENUE NORTH WHEREAS, the City Code, under Section 2010.01 defines intersection sight obstructions and provides remedies for abatement; and, WHEREAS, the property at 18405 -20th Avenue North is owned by Clark and Karen Fischer, and a spruce tree planted on the property line extends into the public right-of-way and within the 20 foot sight triangle area defined in City Code Section 2010.01; and, WHEREAS, the Fischers have been notified by certified mail that this tree on the corner of Urbandale Lane North and 20th Avenue North causes an intersection sight obstruction in violation of City Code Section 2010.01; and, WHEREAS, the City has permitted the Fischers more than 30 days to bring the violation into compliance with the City Code; and, WHEREAS, after this period of time a reinspection of the property was conducted and found that the violation had not been corrected as specified in the certified letter sent to the Fischers; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that if the Fischers do not clear the intersection sight obstruction within two weeks it should and hereby does authorize the City to abate the nuissnce by eliminating those branches of the spruce tree which cause a sight obstruction nuisance at a cost of $50 for labor and administrative costs as estimated by the City Forester; FURTHER, that the property owners will be personally liable for the cost and the administrative fees to remove the violation, per City Code Section 2010.01, and that the City Forester shall remove the sight obstruction as specified by October 31, 1992 if the property owners do not do so. Adopted by the City Council on October 26, 1992.
