RESOLUTION No. 92-635
AUTHORIZING THE VACATION OF A STREET RIGHT OF WAY WITHIN
MEDICINE LAKE PARK THIRD DIVISION
WHEREAS, a petition was received to vacate Wagner Avenue within Medicine Lake Park
Third Division; and
WHEREAS, a public hearing with respect to said vacation was scheduled for October 5,
1992 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of October 5, 1992; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on October 5, 1992 to inform any and all
interested parties relevant to the vacation of street right of way; and
WHEREAS, it was determined by the City Council that said right of way is not needed for
public purposes.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the following portion of Wagner Avenue be vacated as public roadway:
That portion of Wagner Avenue from the south right of way line of Quaker
Lane to the northerly right of way line of Medicine Ridge Road as
dedicated in the plat of Medicine Lake Park Third Division, Hennepin
County, MN.
2. That said vacation shall not affect the authority of any person,
corporation or municipality owning or controlling the electric or
telephone poles and lines, gas and sewer lines, or water pipes, mains and
hydrants thereon or thereunder, to continue maintaining the same to enter
upon such way or portion thereof vacated to repair, replace, remove or
otherwise atter' thereto.
3. That the City of Plymouth reserves easement rights for utility purposes
over, under, and across said vacated street.
