RESOLUTION 92- 552
APPROVING CONDITIONAL USE PERMIT FOR DIAMOND GUS ENTERPRISES, INC. FOR A CLASS
II RESTAURANT (TACO JOHN'S) LOCATED AT 1400 COUNTY ROAD 101 (92074)
WHEREAS, Diamond Gus Enterprises, Inc. has requested a Conditional Use Permit
for a Class II Restaurant (Taco John's) for property located at 1400 County
Road 101; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Diamond Gus Enterprises, Inc. for a Class II Restaurant (Taco John's) for
property located at 1400 County Road 101, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and
Ordinances, and violation thereof shall be grounds for revocation.
2. The permit is issued to the Diamond Gus Enterprises, Inc. as operator of
the facility and shall not be transferable.
3. The site shall be maintained in a sanitary manner.
4. All waste and waste containers shall be stored in accordance with the
approved shopping center Site Plan.
5. Any signage shall conform with the City Ordinance standards.
6. Compliance with applicable Building and Fire Code requirements shall be
verified by the City prior to permit issuance.
7. All parking shall be off-street in designated areas which comply with the
Zoning Ordinance.
8. The permit is for a 1,460 square foot Class II restaurant.
