DENYING AMENDED MIXED PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT
FOR "PLYMOUTH HILLS" TO SUBSTITUTE A LIQUOR STORE/RETAIL MALL CONVENIENCE
STORE/GASOLINE VENDING USE FOR THE "BANK" USE LOCATED AT THE NORTHEAST CORNER
OF 36TH AVENUE NORTH AND VICKSBURG LANE NORTH (92068)
WHEREAS, William C. Rademacher has requested approval for an Amended Mixed
Planned Unit Development Plan and Conditional Use Permit for "Plymouth Hills"
to substitute a liquor store/retail mall convenience store/gasoline vending
use for the "bank" use located at the northeast corner of 36th Avenue North
and Vicksburg Lane North; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing;
NOW, THEREFORE, BE IT HEREBY :.'�30LVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it ::;mould and hereby does deny the request by
William C. Rademacf,er for an Amended Mixed Planned Unit Development Plan and
Conditional Use Permit for "Plymouth Hills" to substitute a liquor
store/retail mall convenience store/gasoline vending use for the "bank" use
located at the northeast corner of 36th Avenue North and Vicksburg Lane North,
based on the following findings:
1. The proposed amendment to the PUD Plan includes uses not compatible with
those uses permitted by the PUD for properties east, north and west of the
site, based on use intensity.
2. The existing PUO Plan and Conditional Use Permit that includes this site,
permits use of the site in harmony with adjoining sites.
