HomeMy WebLinkAboutCity Council Resolution 1992-516• CITY OF PLYMOUTH RESOLUTION 92-516 DENYING SITE PLAN, CONDITIONAL USE PERMIT AND PRELIMINARY PLAT FOR TOLD DEVELOPMENT LOCATED AT THE NORTHEAST CORNER OF FERNBROOK LANE AND COUNTY ROAD 6 (92059) WHEREAS, Told Development has requested approval for a Site Plan and Conditional Use Permit for a convenience store and gas station, for property located at the northeast corner of Fernbrook Lane and County Road 6; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Told Development for a Site Plan and Conditional Use Permit for a convenience store and gas station, for property located at the northeast corner of Fernbrook Lane and County Road 6, based on the following findings: 1. The proposed convenience store/gasoline vending use does not comply with the provisions of Section 8, Subdivision D, paragraph 2b of the Plymouth Zoning Ordinance in that it does not provide goods and services which are primarily for the use of persons employed in the district and these establishments are not essential to the operations of the I-1 District. 2. The establishment, maintenance or operation of the proposed use will not promote and enhance the general welfare and will be detrimental to or endanger the public health, safety, morals or comfort. 3. The proposed use will be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, and will substantially diminish and impair property values within the neighborhood. FURTHER, the Preliminary Plat is denied based on a find;n- that the proposed General Development Plan is inconsistent with the Zoning Ordinance due to the proposal for retail development in the I-1 Zoning District.
