HomeMy WebLinkAboutCity Council Resolution 1992-413CITY OF PLYMOUTH RESOLUTION 92-413 DENYING A CONDITIONAL USE PERMIT AND SITE PLAN, FOR A 156 UNIT MULTI -FAMILY PROJECT FOR GOFF HOMES, INC. LOCATED AT THE INTERSECTION OF 37TH AVENUE NORTH AND XENIUM LANE (92012) WHEREAS, Goff Homes, Inc. has requested approval for a Conditional Use Permit Ind Site Plan for a 156 multi -family project for property located at the intersection of 37th Avenue North and Xenium Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Goff Homes, Inc. for a Conditional Use Permit and Site Plan for a 156 multi -family project for property located at the intersection of 37th Avenue North and Xenium Lane, based on the finding that the Conditional Use Permit application does not comply with all of the mandatory Conditional Use Permit standards of the Zoning Ordinance as follows: 1. The proposed conditional uses will be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted (single family residence), and will substantially diminish and impair property values within the neighborhood as evidenced by various affidavits and an impact study and other documents of record. FURTHER, that the Site Plan is denied due to an inappropriate General Development Plan regarding the rezoning and an unapproved use regarding the Site Plan. FURTHER, that the zoning from FRO to R-4 is denied due to an inappropriate General Development Plan and because the proposed plat differs from the final plat required to be filed as a condition of rezoning granted by Resolution No. 88-154 dated March 7, 1988.
