HomeMy WebLinkAboutCity Council Resolution 1992-373CITY OF PLYMOUTH RESOLUTION 92-373 APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR JAMES AND MARY MAAS LOCATED AT 4850 EVERGREEN LANE NORTH (92043) (RPUD 77-6) WHEREAS, James and Mary Maas have requested approval of an Amended Planned Unit Development Plan and Conditional Use Permit for a 3 -season porch on property located at 4850 Evergreen Lane North to allow for a reduced rear setback from 25 feet to 19.6 feet; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by James and Mary Maas for an Amended Planned Unit Development Plan and Conditional Use Permit for a 3 -season porch on property located at 4850 Evergreen Lane North to allow for a reduced rear setback from 25 feet to 19.6 feet, subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3. The grantingof the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. An enclosed porch is allowed on Lot 16, Block 5, Zachary Hills 4th Addition with a minimum rear yard setback of 19.6 feet. Adopted by the City Council on July 6, 1992.
