HomeMy WebLinkAboutCity Council Resolution 1992-342CITY OF PLYMOUTH RESOLUTION 92-342 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR SHERWOOD PERL FOR 'PARKERS WOODS" LOCATED NORTHEAST OF KINGSVIEW LANE AND THE LUCE LINE TRAIL (91037) WHEREAS, the City Council has approved the Final Plat and Development Contract for Sherwood Perl for Parkers Woods located northeast of Kingsview Lane and the Luce Line Trail; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of recording of the Final Plat. 4. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Approval of Subdivision Code Variances as follow based on compliance with the Subdivision Code Variance Criteria: a. Lot width at the front setback line ranging from 70 feet to 100 feet versus the Zoning Ordinance standard of 110 feet. b. Lot area ranging from, 8,500 square feet to 18,250 feet versus the Zoning Ordinance standard of 18,500 square feet. c. Lot width within the Shoreland Management Overlay District of 70 feet (Lot 5) versus the Zoning Ordinance standard of 75 feet. d. Lot area with the Shoreland Management District of 9,625 square feet (Lot 1), 8,500 (Lot 2), and 11,375 square feet (Lot 3) versus the Zoning Ordinance standard of 15,000 square feet. RESOLUTION NO. 92-342 e. Side yard setback of 10 feet versue the Zoning Ordinance standard of 15 feet. f. Front (street) setback of 30 feet versue the Zoning Ordinance standard of 35 feet. 8. Submission of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 9. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 10. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Adopted by the City Council on June 15, 1992 (res/cc/91037.sc)
