RESOLUTION 92- 282A
APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR H.I. ENTERPRISES, INC.

WHEREAS, H.I. Enterprises, Inc. has requested approval for a Site Plan and
Conditional Use Permit for a convenience store and gas station for property
located at the southeast corner of Fernbrook Lane and Harbor Lane; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
H.I. Enterprises, Inc. for a Site Plan and Conditional Use Permit for a
convenience store and gas station for property located at the southeast corner
of Fernbrook Lane and Harbor Lane, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of building permit issuance.
5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm
water drainage facility.
6. Submission of required financial guarantee and Site Performance Agreement
for completion of site improvements within 12 months of the date of this
resolution.
7. Any signage shall be in compliance with the Ordinance.
8. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
9. Compliance with the Ordinance regarding the location of fire hydrants and
fire 1 anes .
10. All waste and waste containers shall be stored within , and no outside
storage is permitted.
11. An 8h x 11 inch "As Built" Fire Protection Plan shall be submitted prior
to the release or reduction of any site improvement bonds per City Policy.
12. No building permit to be issued until the Lot Division is filed and
recorded with Hennepin County.
