RESOLUTION 92-251
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
HANS HAGEN HOMES, INC. FOR "SEVEN PONDS 4TH ADDITION" LOCATED NORTHWEST OF
DUNKIRK LANE AND COUNTY ROAD 24 (92017) (MPUD 92-01)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Hans Hagen Homes, Inc. for "Seven Ponds 4th Addition";
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Final Plat with Hennepin
County.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.'
8. No building permits shall be issued until a contract has been awarded for
sewer and water, and the MPCA Permit issued.
9. Street names shall comply with the City Street Naming System. Final Plat
Mylars shall refer to RPUD No. 92-1.
10. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the
Final Plat. No conveyance of platted lots may precede filing of homeowner
documents on each lot of the plat.
�- 11. Subsequent phases shall be subject to Ordinance provisions for Plan and
Plat applications for the review and approval.

12. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved MPUD 91-1 per Section 9 or the Zoning Ordinance.
13. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
14. Minimum yard setbacks shall be 35 feet for the front yards, 10 feet and 10
feet for the side yards and 25 feet for the rear yard. A front yard
setback of 30 feet is approved on any lot where it can be demonstrated
that the reduced setback will result in the preservation of natural
features as specifically approved in writing by the Community Development
Director. No more than 25 percent of all residential lots in the Seven
Ponds Second Addition MPUD. including Seven Ponds Third and Fourth
Additions. west of County Road 24 may be approved for the reduced setback.
