HomeMy WebLinkAboutCity Council Resolution 1992-249CITY OF PLYMOUTH RESOLUTION 92- 249 APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCE FOR PARK AVENUE OF WAYZATA, INC. FOR "TRENTON OAKS" LOCATED AT THE NORTH SIDE OF 10TH AVENUE NORTH AND 1 BLOCK EAST OF SOUTH SHORE DRIVE (92015) WHEREAS, Park Avenue of Wayzata, Inc. has requested approval for a Site Plan, Conditional Use Permit and Variance for property located at the north side of 10th Avenue North and I block east of South Shore Drive; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW. THEREFORE, BE IT W,—_JQ' RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Park Avenue of Wayzata for a Site Plan, Conditional Use Permit and Variance to construct 162 townhouse units on property located at the north side of 10th Avenue North and 1 block east of South Shore Drive, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance. 3. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 4. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution. 5. Any signage shall be in compliance with the Ordinance. 6. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 7. All waste and waste containers shall be stored within each building, and no outside storage is permitted. 8. An 8h x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 9. No building permit to be issued until the Final Plat is filed and recorded with Hennepin County. RF-9)UNION \P. 92-249 10. Approved Variance is for the construction of 249 parking spaces versus the ordinance required 405 spaces based on the unique site characteristics; and, the prior approvals of this project under less stringent parking standards. Construction of an additional 20 stalls as depicted on the Site Plan is deferred pending a demonstrated need as determined by the City of Plymouth. Adopted by the City Council on May 4, 1992.
