HomeMy WebLinkAboutCity Council Resolution 1992-216CITY OF PLYMOUTH RESOLUTION 92-216 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR CUSTOM BUILDING CONCEPTS, INC. (91068) WHEREAS, the City Council has approved the Final Plat and Development Contract for Custom Building Concepts, Inc. for "Bitoerin" for nine lots located northwest of 44th Avenue North and Northwest Boulevard; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final flat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 4. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 7. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Access shall be limited to 'nternal public roads and prohibited from Northwest Boulevard. 9. The Development Contract, as approv•d by the City Council, shall be fully executed prior to release of the Final Plat. 10. Rezoning shall be finalized with filing of the Final Plat. 11. Minimum yard setbacks shall be 35 feet for the front yards, 10 feet and In feet for the side yards and 15 feet for the rear yard. A 50 foot minimum front yard is required for lots adjacent to Northwest Boulevard. 12. All existing structures, with the exception of the house, shall be removed prior to issuance of any building permit. The house shall be removed before any of the lots on 44th Avenue North are developed. Adopted by the City Council on April 20, 1992. (res/cc/91068.fp.sc)
