HomeMy WebLinkAboutCity Council Resolution 1992-186CITY OF PLYMOUTH RESOLUTION 92-I86 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR CRAIG AND GARY SCHERBER FOR HOLLY CREEK (91106) (RPUD 92-01) WHEREAS, the Cite Council has approved the Final Plat and Development Contract for Holly Creek; NOW, THEREFORE, BI- IT HEREBY RESOLVE" BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: I. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. The title to Outlot B shall be deeded to the City of Plymouth as satisfaction of park dedication requirements for this initial subdivision phase. Cash payments will be required for additional phases on this subdivision. Park credit will be given for 12.46 lots in future phases of this subdivision with cash payments for all remaining lots. 4. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. 6. Removal of existing structures if any at the developer's expense. 7. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 8. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 9. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 10. Street names shall comply with the City Street Naming System. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 92-01 per Section 9 of the Zoning Ordinance. (see next page) Resolution No. 92-186 Page Two, File 91106 11. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. 12. Minimum yard setbacks shall be 35 feet for the front yards, 15 feet and 15 feet for the side yards except 10 feet for structures on Lots 2 - 7, Block 1, only where living areas abut garages on adjoining lots; and 25 feet for the rear yard. 13. Private drive access shall be limited to internal public roads and restricted from Rockford Road and Dunkirk Lane. 14. The minimum lot width shall be 95 feet. 15. Transitional screening and berming shall be provided along Rockford Road and Dunkirk Lane. 16. A Final Plat for Outlot A will not be considered until Dunkirk Lane improvement are ordered.
