HomeMy WebLinkAboutCity Council Resolution 1992-109CITY OF PLYMOUTH RESOLUTION NO. 92-109 DECLARING FINDING OF NO NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) DATED NOVEMBER 22, 1991 FOR SCHMIDT LAKE ROAD BETWEEN VICKSBURG LANE AND I-494 CITY PROJECT NO. 907. WHEREAS, pursuant to Minnesota Environmental Quality Board (EQB), Rule No. 5, Chapter 4410.4500, the environmental review process, the City of Plymouth, as the responsible governmental unit, submitted an Environmental Assessment Worksheet (EAW) for Schmidt Lake Road between Vicksburg Lane and I-494 on December 9, 1991; and WHEREAS, the 30 day review comment period expired on January 8, 1992 and all comments and recommendations received from reviewing agencies and other interested parties have been considered; and WHEREAS, the City has received concurrence from the Metropolitan Council and Minnesota Pollution Control Agency, there is no need for an Environmental Impact Statement; and WHEREAS, the City has conducted `.raffic studies which indicate the road is necessary to provide adequate traffic circulation for development of the area in accordance with the City's Land Use Guide Plan; and WHEREAS, the concept of the roadway is in accordance with the City's Thoroughfare Guide Plan, originally adopted in 1972 with the current plan revised in 1989; and WHEREAS, from an environmental impact standpoint, Alternatives 1 and 2 are essentially equal; and WHEREAS, avoidance, minimization, and mitigation measures for encroachment into wetlands will be addressed as part of the design and permit process; and WHEREAS, in determining whether the extension of Schmidt Lake Road between Vicksburg Lane and I-494 have the potential for significant environmental effects, the City Council has considered the following factors: 1. type, extent and reversibility of environmental effects; 2. cumulative potential effects of related or anticipated future projects; 3. the extent to which the environmental effects are subject to avoidance, minimization and mitigation by ongoing public regulatory authority; 4. the extent to which environmental effects can be anticipated and controlled as a result of other environmental studies undertaken by public agencies of the project proposer, or of EIS's previously prepared on similar projects; and RESOLUTION NO. 92-109 DECLARING FINDING OF NO NEED FOR AN ENVIRONMENTAL IMPACT STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) Page Two WHEREAS, after comparing the impact that may be reasonably expected to occur as the result of the extension of Schmidt Lake Road between Vicksburg Lane and I-494 with the criteria set forth above, the City Council has determined that the proposed project does not present a potential for significant environmental effects. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: that it should and hereby does make a negative declaration on the need for an environmental Impact Statement (EIS) for the proposed extension of Schmidt Lake Road between Vicksburg Lane and I-494. Adopted by the City Council on February 3, 1992
