HomeMy WebLinkAboutCity Council Resolution 1992-084CITY OF PLYMOUTH RESOLUTION 92-34 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR CRAIG AND GARY SCHERBER FOR HOLLY CREEK LOCATED IN THE SOUTHWEST QUADRANT OF ROCKFORD ROAD AND DUNKIRK LANE (91106) WHEREAS, Craig and Gary Scherber have requested approval for a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for property located in the southwest quadrant of Rockford Road and Dunkirk Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Craig and Gary Scherber for a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use permit for property located in the southwest quadrant of Rockford Road and Dunkirk Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and trail paving costs and according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Rezoning shall be finalized with the filing of thr Final Plat. (see next page) Resolution No. 92-84 Page Two, File 91106 8. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 9. Private drive access shall be limited to internal public roads and restricted from Rockford Road and Dunkirk Lane. 10. Transitional screening and berming shall be provided along Rockford Road and Dunkirk Lane. 11. Final Plat mylars shall refer to RPUD 92-1. 12. The minimum side setback shall be 15 feet; except 10 feet for structures on Lots 2-7, Block 5 and Lots 6-8, Block 1 only where living areas abut garages on adjoining lots; the minimum rear setback shall be 25 feet; and the minimum front setback shall be 35 feet. 13. The minimum lot width shall be 95 feet. 14. Compliance with the terms of City Council Resolution 89-439 regarding tree preservation. Adopted by the City Council on February 3, 1992. (res/cc/91106.pp)
