REQUEST FOR PAYMENT NO. 4 AND FINAL
WEST MEDICINE LAKE DRIVE - TRAIL IMPROVEMENTS
CITY PROJECT NO. 931
WHEREAS, the City of Plymouth as owner and Barber Construction Co., Inc.
as contractor, have entered into an agreement for West Medicine Lake
Drive - Trail Improvements, City Project No. 931, said agreement being
dated July 20, 1990; and
WHEREAS, the Engineer has certified acceptance of the work and approval of
the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $235,285.10. No
change orders were approved, and the value of the work
to date is $248,199.12 and is herewith approved. This
project overran the contract amount by $12,914.02 or
5.482.
2. That the work performed by the Contractor for West
Medicine Lake Drive - Trail Improvements and certified
to the Council by the engineer as acceptable, being the
same, is hereby released from the contract except as to
the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 4 and Final in the amount of
$7,130.57 to Barber Construction Co., Inc. for West
Medicine Lake Drive - Trail Improvements is hereby
approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
