HomeMy WebLinkAboutCity Council Resolution 1992-007CITY OF PLYMOUTH RESOLUTION 92-7 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT AMENDMENT FOR RICHARD LIEN (91107) (RPUD 77-7) WHEREAS, Richard Lien has requested approval of an Amended Planned Unit Development Plan and Conditional Use Permit to allow for a swimming pool and 5 foot fence to encroach into the front setback for property located at 12605 50th Avenue North and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Richard Lien for a Residential Planned Unit Development Plan Conditional Use Permit amendment to allow for a swimming pool and 5 foot fence to encroach into the front setback for property located at 12605 50th Avenue North, subject to the following findings and conditions: 1. No other amendments and variances are granted or implied. 2. All applicable equirements of the City and State Building Codes shall be applied and enforced; no code requirements are waived by this approval. 3. The granting of the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. Setbacks granted for this site are a 22 foot front yard setback for the swimming pool and, the setback for the fence paralleling Oakview Lane a minimum of 17 feet and generally following the easterly edge of the patio surface as depicted on the applicant's drawing received by the City of Plymouth November 22, 1991.
