Pursuant to due call and notice thereof, a regular
meeting of the City Council of the City of Plymouth, Minnesota,
was held on the 21st day of October , 19 91 The following
members were present:
Mayor Berman, Councilmembers Helliwell Ricker, Vasiliou, and 7it„r
The following members were absent: None
Councilmember Ricker introduced the following
Resolution and moved its adoption:
RESOLUTION 91- 684
RESOLUTION DENYING THE APPEAL OF ROBERT F. HUGHES PERTAINING TO
THE UNIFORM FIRE CODE REQUIREMENT FOR SPRINRLERING IN A BASEMENT.
WHEREAS, the Fire Inspector for the City of Plymouth on November
15, 1990 ordered Robert F. Hughes, the owner of the building
located at 4130 Highway 101 DBA as the Party Mart Liquor Store to
install a fire sprinkling system in the basement; and,
WHEREAS, Robert F. Hughes has appealed the ruling by the City's
Fire Inspector; and,
WHEREAS, the Plymouth City Code designates the City Council as
the Board of Appeals for such an appeal;
NOW, THEREFORE LET IT HEREBY BE RESOLVED BY THE CITY COUNCIL OF
THE C:,!Y OF PLYMOUTH, MINNESOTA as follows;
1. There is presently a significant hazard to occupants and/or
responding firefighters at this building in the event of a
fire.
2. The building originally was not built in conformance with the
code that was in effect at the time of the -construction; and
the basement should have been sprinklered at the time.
The motion for adoption of the foregoing Resolution was duly
seconded by
Councilmember Vasiliou , and upon vote being taken thereon,
the following voted in favor thereof: Mayor Berman,
Councilmembers Helliwell, Ricker, Vasiliou, and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
