RESOLUTION 91-649
SETTING CONDITIONS TO BE MET PRIOR 10 FILING OF AND RELATED TO FINAL PLAT FOR
HANS HAGEN HOMES, INC. FOR "SEVEN PONDS SECOND ADDITION" LOCATED AT THE
SOUTHWEST CORNER OF DUNKIRK LANE AND STATE HIGHWAY 55 (91062) (MPUD 91-1)
WHEREAS, the City Council has approved the MPUD Final Plat and Development
Contract for Hans Hagen Homes, Inc. for "Seven Ponds Second Addition";
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property shall be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication according to the
Dedication Policy in effect at the time of filing the Final Plat with
Hennepin County with appropriate credits in an amount determined according
to verified trail paving costs and dedication of .463 net acres for a
neighborhood park.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Approved setbacks for residential lots are 35 feet front except 50 feet
abutting Medina Road and County Road 24; 10 feet side and 25 feet rear.
The lot at the northwest corner of 34th Avenue North and Jewel Lane may
have a 20 foot structure setback to Jewel Lane based on a finding that
preservation of wetland areas of the site will result from a reduction in
the setback and on the condition that the house located on this lot will
front 34th Avenue North.
8. Setbacks for Service Commercial and Industrial lots shall comply with
applicable Zoning Ordinance standards.

9. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
10. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
11. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the
Final Plat.
12. The Final Plat mylars shall ccntain a statement noting that the plat is
part of the approved MPUD 91-1 per Section 9 of the Zoning Ordinance.
13. Access shall be limited to internal public roads and prohibited from
Medina Road and County Road 24 except as approved by a future Site Plan
for Lot 1, Block 5.
14. The Development Contract, as approved by the 11ity Council, shall be fully
executed prior to release of the Final Plat.
15. Development of Lot 1, Block 4; Lot 1, Block 5; and, Lot 1, Block 6 is
subject to approval by the City of a MPUD Final Site Plan.
