RESOLUTION 91-596
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT FOR
LUNDGREN BROS. CONSTRUCTION FOR CHURCHILL FARMS 2ND ADDITION (91079) (RPUD
90-1)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Churchill Farms;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with
City Policy in effect at the time of filing the Plat with Hennepin County.
3. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
4. Removal of all dead or dying trees from the property at the owner's
expense.
5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
6. No yard setback variances are granted or implied except as listed herein.
7. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.
8. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the
Final Plat.
9. The Final Plat mylars shall contain a statement noting that the plat is
part of the approved RPUD 90-1 per Section 9 of the Zoning Ordinance.

10. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
11. A 30 minimum foot front yard setback is granted on the following lots:
Block 4, Lots 1, 2, and 3 (31th Place North side).
12. Compliance with the provisions of City Council Policy Resolution 89-439
regarding tree preservation.
13. All decorative fencing shall to installed prior to issuance of building
permits on the lots where fenc4-g is approved.
14. Street names shall comply with the City of Plymouth grid system.
