RESOLUTION 91-576
APPROVING AMENDED MIXED PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN AND
CONDITIONAL USE PERMIT FOR OPUS CORPORATION (91039)
WHEREAS, OPUS Corporation has requested approval for an amended Mixed Planned
Unit Development Preliminary Plan and Conditional Use Permit to modify the
westerly 1,050 feet of the proposed landscaping berm along the north property
line adjacent to the City of Maple Grove for property located at the northwest
quadrant of County Road 10 (Bass Lake Road) and State Highway 169; and,
WHEREAS, the City Council, by Resolution 89-701, approved a Mixed Planned Unit
Development (MPUD Preliminary Plat/Plan and Conditional Permit for the Bass
Creek Business Park);
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
OPUS Corporation for an amended Mixed Plan Unit Development Preliminary Plan
and Conditional Use Permit to modify the westerly 1,050 feet of the proposed
landscaping and berm along the north property line adjacent to the City of
Maple Grove for property located at the northwest quadrant of County Road 10
(Bass Lake Road) and State Highway 169, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
3. Compliance with the applicable terms and conditions of City Council
Resolution 89-701 (MPUD Preliminary Plat/Plan and Conditional Use Permit),
90-356 and 90-357 (MPUD Final Plat and Development Contract).
4. This amendment approves a modification to the grading and landscape plan
to allow berming and landscape treatment along the north property line
consistent with plans dated August 14, 1991, where the height of the berm
is reduced 4 feet and the location of the berm is adjusted southerly.
