HomeMy WebLinkAboutCity Council Resolution 1991-573CITY OF PLYMOUTH RESOLUTION NO. 91- 573 AUTHORIZING THE VACATION OF A PORTION OF 10TH AVENUE WITHIN PARKDALE ADDITION AND GLEN GROVE ACRES FIRST ADDITION WHEREAS, a petition was received to vacate a portion of 10th Avenue within Parkdale Addition and Glen Grove Acres First Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for September 16, 1991 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 16, 1991; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on September 16, 1991 to inform any and all interested parties relevant to the vacation of said street; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following: 1. That portion of 10th Avenue from the west plat line of Glen Grove Acres First Subdivision, Hennepin County, Minnesota, to a point 124 feet west of the cos on lot line between Lots 4 and s, Block 1 of said addition according to the recorded plat thereof. Also that portion of 10th Avenue from the east plat line of Lot 1, Block 3, Parkdale Addition, to a point 155 feet west of said east line within Parkdale Addition according to the recorded plat thereof. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. 3. That the City of Plymouth reserves easement rights for drainage and utility purposes over, under and across said vacated street. Adopted by the City Council on October 7, 1991.
