HomeMy WebLinkAboutCity Council Resolution 1991-537CITY OF PLYMOUTH RESOLUTION 91- 53' APPROVING MIXED USE PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT/CONDITIONAL USE PERMIT AND SUBDIVISION VARIANCE FOR HANS HAGEN HOMES FOR SEVEN PONDS 2ND ADDITION (91062) WHEREAS, Hans Hagen Homes has requested approval of a Mixed Use Planned Unit Development Preliminary Plan/Plat/Conditional Use Permit and Subdivision Variance for the development of 106.86 acres located at Southwest corner of Dunkirk Lane and State Highway 55; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Mixed Use Planned Unit Development Preliminary Plan/Plat/Conditional Use Permit and Subdivision Variance for the de-elopment of 106.86 acres located at the Southwest corner of Dunkirk Lane and State Highway 55; subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead )r dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Provisions for a 30 -foot wide trail easement south of and parallel to County Road 24 and a 10 foot trail easement parallel to the west line of the plat from 32nd Avenue North to the "Park" along County Road 24 per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards with the initial Final Plat. 5. Payment of park dedication fees -in -lieu of dedication according to the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County with appropriate credits in an amount determined according to verified trail paving costs and dedication of .463 net acres for a neighborhood park. 6. Street names shall comply with the City Street Naming System. 7. Rezoning shall be finalized with the filing of the Final Plat. Resolution No. 91-53' Page Two File 91062 8. No building permit to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Approved setbacks for residential lots are 35 feet front except 50 feet abutting Medina Road and County Road 24; 10 feet side and 25 feet rear. The lot at the southeast corner of 33rd Avenue North and Jewel Lane and the lot at the northwest corner of 34th Avenue North and Jewel Lane may have a 20 foot structure setback to Jewel Lane based on a finding that preservation of wetland areas of the site will result from a reduction in the setback and on the condition that the houses located on these lots will front 34th Avenue North and 33rd Avenue North respectively. 10. Residential private drive access shall be limited to internal public roads and restricted from County Road 24 and Medina Road. 11. Appropriate legal documents regarding Homeowners Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. 12. No project monument signage is proposed or approved by this action. 13. Approval is conditioned on the approval of the Metropolitan Council of the Land Use Guide Plan amendments affecting this site previously approved by the City Council. 14. A Subdivision Ordinance Variance is approved based on compliance with the Subdivision Ordinance Variance Criteria to permit a cul-de-sac length for 32nd Avenue North of 1750 feet versus the Ordinance standard of 500 feet on a condition that an emergency access be provided, to be approved by the City Engineer, from 32nd Avenue North south to County Road 24. 15. Permanent access to Lot 1, Block 5 shall be redirected to an internal public street in lieu of access to Medina Road; except temporary access to Medina Road will be permitted until Lot 2, Block 10 is platted and the plat shall provide for the permanent access from internal public streets for Lot 1, Block 5. 16. Minimum lot width at the setback line shall be 75 feet. Adopted by the City Council on September 16, 1991. (res/pc/91062.pp:jw)
