RESOLUTION 91-509
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO FINAL PLAT OF
THE AVONLEA FOR JAMES AND CORINNE GUDDAL FOR PROPERTY LOCATED AT 4465
VICKSBURG LANE (90087)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for James and Corinne Guddal for property located at 4465 Vicksburg Lane;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to
be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The Ordinance rezoning the property small be published upon evidence that
the Final Plat has been filed and recorded with Hennepin County.
3. Payment of park dedication fees -in -lieu of dedication for the two lots in
accordance with City Policy in effect at the time of filing of the Final
Plat.
4. No building permits shall be issued until a contract has been awarded for
the construction of municipal sewer and water.
5. Removal of all dead or dying trees from the property at the owner's
expense.
6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open
storm water drainage facility.
7. Approved variances are:
a. Lot Width at the setback for Lot 2 (75 feet) and Lot 3 (58 feet)
versus the Zoning Ordinance standard of 90 feet.
b. Lot Width in the Shoreland Management District for Lot 3 (58 feet)
versus the Zoning Ordinance standard of 75 feet.
8. Submittal of required utility and drainage easements as approved by the
City Engineer prior to filing the Final Plat.

9. No building permits to be issued until the Final Plat is filed and
recorded with Hennepin County.
10. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
11. Access to Lot 1 from Vicksburg Lane may continue while James and Corrine
Guddal continue to own that lot and reside there. Public street access to
Lot 1 shall be relocated to 45th Avenue North prior to ownership or
occupancy of Lot 1 by other than James and Corrine Guddal.
As an alternative, to be selected prior to recording of the Final Plat,
the petitioners may elect to relocate public street access to Lot 1 from
Vicksburg lane to 45th Avenue North (permanently vacating access to
Vicksburg Lane) prior to issuance of a building permit for Lot 2 or Lot 3.
If this alternative is selected a partial refund of street assessments for
Vicksburg Lane improvements is directed.
A covenant shall be prepared by the petitioner and approved by the City
Attorney to be recorded on the titles of Lots 1, 2 and 3 evidencing this
condition. The Vicksburg Lane access shall be closed when the first
building permit application is submitted.
12. In lieu of removal of the existing accessory structures on proposed Lot 2
by the owner prior to filing the Final Plat a covenant, satisfactory to
the City Attorney, shall be prepared by the petitioner and recorded on the
title of Lot 2, at the time the Final Plat is filed requiring the removal
of all accessory structures prior to issuance of a building permit for Lot
2. The garage should be removed at the time a building permit application
is submitted if the garage does not comply with the zoning requirements at
that time.
13. Driveway easements allowing access for Lot 1 to 45th Avenue North across
Lots 2 and 3 shall be submitted by the petitioner, approved by the City
Engineer, and recorded with the Final Plat regardless of the alternative
selected in #11 above.
14. Access to Vicksburg Lane from Lot 3 is prohibited.
