HomeMy WebLinkAboutCity Council Resolution 1969-399EXTRACT OF MINUTES OF SPECIAL MEETING OF VILLAGE COUNCIL OF VILLAGE OF PLYMOUTH, MINNESOTA OCTOBER 27, 1969 Pursuant to due call and notice thereof a special meeting of the Village Council of the Village of Plymouth was held on October 27, 1969 at the Village Hall, 13800 State Highway No. 55, commencing at 7:30 o'clock p.m. The following members were present: Mayor Hilde, Councilmen Hintz, Johnson, and Humphrey. The following members were absent: Mom Councilman Kindseth. eouneilmgn, Johnson introduced the following resolution and moved its adoption: "RESOLUTION NO. 69- 399 A RESOLUTION AUTHORIZING THE USE OF EMINENT DOMAIN PROCEEDINGS FOR THE PURPOSE OF ACQUIRING CERTAIN SANITARY SEWER EASEMENTS WITH RESPECT TO PROJECT NO. 69-1-0-C WHEREAS, it is essential that the Village acquire certain easements for the purpose of constructing and installing sanitary sewer service to the Zachary Lane School which project is known as No. 69-1-0-C, and WHEREAS, has been deemed to be essential that said sanitary sewer be available to said school not later than December 1, 1969, and WHEREAS, in order that the construction and installation of said sanitary sewer will not be delayed, NOW THEREFORE BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH AS FOLLOWS: 1. That the Village Attorney is hereby authorized and directed to commence proceedings in eminent domain for the purpose of acquiring easements over, under and across the following described property: Parcel 1. A permanent easement over the North 10 feet of the South 43 feet of the East 160 feet of the South 272.25 feet of the Northeast 1/4 of the Northwest 1/4, Section 13, Township 118, Range 22 -and- A temporary construction easement over the North 20 feet of the South 63 feet of the above-described pa,: cel . Parcel 2. A permanent sanitary sewer easement over, under ani across the North 10 feet of that part of the South 272.25 feet of rhe East 1/4 of the Northeast 1/4 of the Northwest 1/4 lying West of the East 160 feet thereof and that. part of the East 1/4 05 the Northeast 1/4 of the Northwest 1/4 lying North of the South 272.25 feet thereof, all in Section 13, Township 118, Range 22 -and- A temporary construction easement over the North 20 feet of the South 63 feet of the above-describeM parcel. Parcel 3. A permanent sanitary sewer easement over e No i 10 feet of the South 43 feet of the West 1/2 of the East: 1/2 of the Northeast 1/4 of the Northwest 1/4 of Section 13, Township 118, Range 22 -and- A temporary construction easement over the North 20 feet of the South 63 feet of the above-described parcel. 2. The Clerk -Administrator is hereby directed to furnish a certified copy of this resolution to the Village Attorney in connection with such eminent domain proceedings." The above motion was seconded by Councilman Humphrey and upon vote being taken thereon the following voted in favor thereof: Mayor Hilde, Councilmen Hintz, Johnson, Kixkbtad�hc and Humphrey.
