HomeMy WebLinkAboutCity Council Resolution 1991-448CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the Sth day of August , 1991. The following members were present: Mayor Berges, Councilmembers , Helliwell. Ricker, Vasi iou, and Zitur The following members were absent: None Councilmember Zitur _ introduced the following Resolution and moved its adoption: RESOLUTION NO. 91- 448 REDUCING DEVELOPMENT BOND WILLOW MEADOWS 2ND ADDITION (88035) WHEREAS, in accordance with the development contract dated October 4, 1988, Christian Church (Disciples of Christ) In the Upper Midwest and Independent School District 284, developer of Willow Meadows 2nd Addition (88035), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the development bond to reflect the completed work; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the bonding requirements are reduced as follows: KTA7. Street Construction Sanitary Sewer Watermain Storm Sewer Boulevard and Drainage Swale Sod Pond or Ditch Construction Street Signs Site Grading and Drainage Improvements (See Grading Permit 117071) Park and Trail Improvements Design, Administration, Inspection, As-Builts TOTAL $ 66,085 $ -0- 23,200 -0- 61,340 -0- 42,680 -0- 5,000 -0- -0- -0- 450 -0- -0- -0- 4,830 24.430 -0- -0- $ 228,015 $ -0- That the letter of credit required for the above items be reduced as detailed above from $23,946 to $0 (zero) to reflect the completed work. WILLOW MEADOWS 2ND ADDITION (88035) Resolution No. 9i-448 Page Two FURTHER BE IT RESOLVED that the bonding requirements for the following items per Section 8.1 of the approved development contract be reduced as follows: 4�1�+3i Maintenance of Erosion and Sediment Control Plan Street Sweeping and Storm Sewer Cleaning Cash: $1,000 $-0- Letter of Credit: $42,400 $-0- FURTHER BE IT RESOLVED that the cash deposit required for the above items is reduced from $1,000 to $0 (zero) and the letter of credit is reduced from $10,000 to $0 (zero). The remaining funds can be returned to the developer forthwith. In lieu of the required maintenance bond for sanitary sewer, watermain, storm sewer, street construction and concrete curb and gutter, the developer agreed to a 10Z retainage for a one year period for the utility and street construction. This period began October 16, 1989 and ended October 16, 1990, therefore, the 1Ox retainage shall be returned to the developer forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by _ Coimeilmember Helliw.lI , and upon vote being taken thereon, the following voted in favor thereof: M=r Berman, Councilmembers Helliwell, Ricker, Vasiliou, and Zitur, The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
