Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was hid on the 5th day
Of August 1991 The following members were present:
Mayor Berman, Councilmembers Helliwell Ricker, Vasiliou, and Zitur
The following members were absent: None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 91- 441
AUTHORIZING RELEASE OF SITE PERFORMANCE GUARANTEE FOR TREE PRESERVATION FOR
INDEPENDENT SCHOOL DISTRICT # 284 FOR KIMBERLY LANE SCHOOL (90031)
WHEREAS, the City Council approved an Urban Development Policy variance, Site
Plan, and Conditional Use Permit for Independent School District # 284
(Wayzata) by Resolution 90-337 on June 4, 1990; and,
WHEREAS, a Tree Preservation Plan regarding the preservation of trees on the
site was required; and,
WHEREAS, the Developer provided a financial guarantee in the amount of $11,425
to secure execution of the Tree Preservation plan that was approved; and,
WHEREAS, the City Forester has certified the Developer has complied with the
Tree Preservation Plan, and he now recommends release of the financial
guarantee;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CIT'.-OUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does authorize and direct the
release of the financial guarantee consisting of a savings certificate for
tree preservation for Kimberly Lane School in the amount of $11,425.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Helliwell and upon vote being taken thereon,
the following voted in favor thereof: m=r Bergman. Councilmembers
Helliwell, Ricker Vasiliou and Zitur
The following voted against or abstained None
Whereupon the Resolution was declared duly passed and adopted.
