Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the Srh day
Of August, 19n_ The following members were present:

moved its adoption:
RESOLUTION 91-436
APPROVING CONDITIONAL USE PERMIT FOR NC BERKSHIRE LANE I LIMITED PARTNERSHIP
(TRAMMELL CROW COMPANY). (90063)
WHEREAS, NC Berkshire Lane I Limited Partnership (Trammell Crow Company) has
requested approval for a Conditional Use Permit under Section 6, Subdivision A
of the Zoning Ordinance for placement of fill and excavation of ponding areas
within the floodway of Plymouth Creek for property located between Fernbrook
Lane and Interstate 494 at 34th Avenue North; and,
WHEREAS, The City Engineer has reported all technical information submitted by
the applicant to be in compliance with the standards of Section 6, Subdivision
A of the Zoning Ordinance; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by NC
Berkshire Lane I Limited Partnership (Trammell Crow Company) for a Conditional
Use Permit for placement of fill and excavation of ponding areas within the
floodway of Plymouth Creek for property located between Fernbrook Lane and
Interstate 494 at 34th Avenue North, subject to the following conditions:
I. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
2. The permit is issued to NC Berkshire Lane I Limited Partnership (Trammell
Crow Company)and shall not be transferable.
3. All fill activity shall be carried out in strict compliance with approved
plans.
4. The activity is in compliance with the Conditional Use Permit standards of
Section 6, Subdivision A of the Zoning Ordinance.
The motion for adoption of the foregoing Resolution was duly seconded
by ilmember Helliwelland upon vote being taken thereon,
the following voted in favor thereo Mayor Ber�►an, Councilmembers Helliwell,
_Ricks -,1`, Yasi1ioll, and Zitur
The rollowing voted against or abstained None
Whereupon the Resolution was declared du y passed and adopted.
