HomeMy WebLinkAboutCity Council Resolution 1991-435CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 5th day Of August 1991 The following members were present: Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Councilmember Za.tur introduced the following Resolution and moved its adoption: RESOLUTION 91-435 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO THE MPUD FINAL PLAT FOR NC BERKSHIRE LANE I LIMITED PARTNERSHIP (TRAMMEL CROW COMPANY). (90063) (MPIID 90-1) WHEREAS, the City Council has approved the MPUD Final Plat, Plan and Development Contract for NC Berkshire Lane I Limited Partnership (Trammell Crow Company) for Plymouth Business Center 5th Addition; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. No yard setback variances are granted or implied. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. The Final Plat mylars shall contain a statement noting that the plat is part of the approved Mixed Planned Unit Development 90-1 per Section 9 of the Zoning Ordinance. Resolution No. 91-435 Page Two File 90063 10. Access shall be limited to internal public roads and prohibited from Fernbrook Lane. 11. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. 12. The landscaping on Lot 2, Block 2 shall be done at existing grades to the maximum extent possible concurrent with the development of the initial plat and/or Site Plan within the PUD. 13. A conservation easement as approved by the City Attorney shall be filed with the final plat and shall address the issues contained in the December 17, 1990 memorandum from the applicant, with the addenda from Mr. Turner. 14. Park dedication requirements shall be met through payment of fees in lieu of dedication, consistent with the Park Dedication Policy and fees in effect at the time of Building Permit issuance with credit for construction of the public trail and bridge parallel and across Plymouth Creek, which shall be concurrent with development of the first lot within the plat. 15. Final Site Plans for Lot 1, Block 2 and Lot 2, Block 2 shall specifically address tree preservation and visual transition to adjoining residential parcels. The motion for adoption of the foregoing Resolution was duly seconded y Councilmember Helliwell , and upon vote being taken thereon, the following ng voted in favor thereof: mayor Bergm=, Councilmembers Helliwell Ricker Vasiliou and Zitur The following voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
