Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Plymouth, Minnesota, was held on the Sth day
of August 19 91 The following members were present:
Mayor rgman, Councilmembers Helliwell, Ricker. Vasiliou, Zi_tur.
The following members were absent: None
Councilmember Zitur introduced the following Resolution and
moved its adoption:
RESOLUTION 91- 427
APPROVING AMENDED CONDITIONAL USE PERMIT AND SITE PLAN FOR DELTAK CORP.

WHEREAS, Deltak Corp. has requested approval for an Amended Conditional Use
Permit and Site Plan to allow expansion to outside storage for property
located at 13330 12th Avenue North; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Deltak Corp. for an amended Conditional Use Permit and Site Plan to allow
expansion to outside storage property located at 13330 12th Avenue North, and
subject to the following conditions:
I. Compliance with the Engineer's Memorandum.
2. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
3. The permit is issued to Deltak Corp. for this property and shall not be
transferable.
4. The site shall be maintained in a sanitary manner.
5. All parking shall be off-street in designated areas which comply with the
Zoning Ordinance.
6. Submission of required financial guarantee and Site Performance Agreement
for completion of site improvements within 12 months of the date of this
resolution.
7. Any signage shall be in compliance with the Ordinance. No new signage is
hereby approved.
8. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.

9. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes.
10. All waste and waste containers (including those for recycling) shall be
stored within the approved enclosure.
11. A waiver is hereby approved consistent with the provision of Section 10,
Subdivision C, Paragraph 4b. of the Zoning Ordinance to allow breaks in
the screening along the north and east property lines per the plans dated
July 5, 1991.
The motion for adoption of the foregoing Resolution was duly seconded
by Councilmember Helliwetl , and upon vote being taken thereon,
the following voted in favor thereof: Berg =, Helliwell, Ricker, Vasil'

Whereupon the Resolution was declared duly passed and adopted.
