Pursuant to due call and notice thereof, a re�p,ij nr meeting of the City
Council of the City of Plymouth, Minnesota was held on the 22nd day of
July , 1991. The following members were present: ,
Mayor Bergman, Councilmembers Ricker. Vasiliou and Zitur ,
The following members were absent: Councilmemher Helliwell
Councilmember Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 91- 408
REQUEST FOR PAYMENT NO. 3 - FINAL
45TH/46TH AVENUE TRAIL - ZACHARY LANE TO REVERE LANE
CITY PROJECT NO. 024
WHEREAS, the City of Plymouth as owner and Bituminous Consulting and
Contracting Company, Inc., as contractor, have entered into an agreement for
trail construction between Zachary Lane and Revere Lane known as City Project
No. 024, said agreement being dated August 23, 1990; and
WHEREAS, the contractor has requested final payment and a reduction in
retainage from 21 to OZ based on completion of required work, plus the fact
that all turf was established during the fall of 1990 and is in good
condition; and
WHEREAS, the City Engineer concurs with the contractor's request and is
satisfied that all of the required work on City Project No. 024 has been
completed in a workmanlike manner and in accordance with the terms of the
contract.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $30,230.95 and the
total value of the work completed to date is $30,637.48.
2. That Payment No's 1 and 2 have been made based on a 2Z
retainage, therefore, the total amount paid to date is
$30,024.73.
3. That Request for Payment No. 3 (Final) in the amount of
$612.75 based on the final contract amount of $30,637.48 is
hereby approved and the City Finance Director is hereby
authorized and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Coun ilmem er Zitur , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Beroun. Councilmembers Ricker. Vasi iou, ,
and Zitur
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
