'he following members were present: _ Mayor Bergman, Councilmembers Ricker, Vasiliou and Zitur The following members were absent: Councilmember Helliwell Councilmember Ricker introduced the following Resolution and moved its adoption. RESOLUTION NO. 91-402 DENYING APPEAL OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING BY DENNIS DANGER, 11715 28TH AVENUE NORTH (06-01-91) WHEREAS, Dennis Danger has appealed a ruling by the Board of Zoning Adjustments and Appeals denying his request for a variance for a 2.17 foot encroachment into the required side yard setback of 15 feet for the construction of a three season porch addition onto his home; WHEREAS, the Board of Zoning Adjustments and Appeals denied the request by Resolution B91- 06, and; WHEREAS, the City Council has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the appeal by Dennis Danger based on the `ollowing findings: 1. No particular hardship related to the physical surroundings, shape or topographical conditions of the specific parcel have been demonstrated to create a particular hardship as distinguished from a mere inconvenience, if the strict letter of the regulations were to be carried out. 2. The conditions upon which this petition for variation are based are not unique to this parcel of land. 3. The petitioner could redesign the porch so as to eliminate the need for a side yard variance. 4. This would establish an undesirable precedent within the City. The motion for adoption of the foregoing Resolution was duly seconded by Ma or Bergman and upon vote being taking thereon, the following voted in favor thereof: Mavor Bergman_ CouncilmembersRicker_ Vasiliou_ and Zitur The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopte
