HomeMy WebLinkAboutCity Council Resolution 1991-399CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 22nd day of _,T,,l:y, 19_21_ The following members were present: siliou, and Zitur The'follovCing members were absent: Councilmember Helliwell introduced the following Resolution and move its adoption: RESOLUTION 91- 399 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT AMENDMENT FOR RICHARD STEINER (91045) (RPUD 77-3) WHEREAS, Richard Steiner has requested approval of a Planned Unit Development Plan Conditional Use Permit amendment for property located at 120 Holly Lane in the Kingswood Farms Addition to allow for reduced rear yard setback of 18 feet versus the Zoning Ordinance standard of 25 feet, and impervious surface lot coverage in the Shoreland Overlay District of 41% versus the Zoning Ordinance standard of 30%; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Richard Steiner for a Planned Unit Development Plan Conditional Use Permit amendment to allow reduced minimum rear yard setback of 18 feet versus the Zoning Ordinance standard of 25 feet, and maximum impervious surface in the Shoreland Overlay District of 41% versus the Zoning Ordinance standard of 30% for property located at 120 Holly Lane in the Kingswood Farms Addition, subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no code requirements are waived by this approval. 3. The granting of the permit is responsive to standards of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. Compliance with all applicable conditions of Resolutions 78-271 (Preliminary Plan and Conditional Use Permit), Resolution 78-502 (Final Plat and Plan) and the Development Contract for Kingswood Farms. The impervious surface coverage for this property is now 38% which is a bona fide nonconforming standard due to the approval of the site design per ordinance criteria and requirements before the Shoreland Management Overlay District was established.
