HomeMy WebLinkAboutCity Council Resolution 1991-392CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 1991. The followingmembers were Mayor day of ,Jli v present: T1a Bergman, CounciLmembers Ricker, , Vasiliou, and Zitur The following members were absent: Crw:cilmember Helliwell **rr Councilmember Ricker introduced the following Resolution and moved its adoption: RESOLUTION NO. 91-392 AUTHORIZING THE VACATION OF 50k PLACE NORTH SUNRISE HILL ADDITION WHEREAS, a petition was received to vacate 50� Place North right-of-way adjacent to Lots 1, 2 and 3, Block 2 Sunrise Hill Addition, (Section 12, Township 118, Range 22, Hennepin County); and WHEREAS, a public hearing with respect to said vacation was scheduled for July 22, 1991 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 22, 1951; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on July 22, 1991 to inform any and all interested parties relevant to the vacation of a street right-of-way (50h Place North); and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following street right-of-way be vacated: 1. 50J Place North adjacent to Lots 1, 2 and 3, Block 2, Sunrise Hill Addition, Hennepin County. MN according to the recorded plat thereof. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, or water lines, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto. 3. No private access will be allowed from Zachary Lane to Lot 1, Block 2, Sunrise Hill Addition, after Zachary Lane is improved with curb and gutter. The motion for the adoption of the foregoing Resolution was duly seconded by C.oimcilmemher Zitur , and upon vote being taken thereon, the following voted in favor thereof: _ Mayor Bergman, Councilmembers Ricker, Vasiliou, and Zitur The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
