HomeMy WebLinkAboutCity Council Resolution 1991-368CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of July , 19 91 The following members were present: Mayor Ber an Councilmembers Helliwell Ricker Vasiliou. and Zitur The following members were absent: None Councilinember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION 91- 368 AUTHORIZING RELEASE OF SITE PERFORMANCE GUARANTEE FOR HEALEY RAMME COMPANY FOR TIMBERTON (83054) WHEREAS, a Site Plan for Timberton located at 26th Avenue North east of Vicksburg Lane was approved under City Council Resolution 83-633; and, WHEREAS, the developer submitted the required Site Performance Guarantee in the form of a Letter of Credit in the amount of $160,725; and, WHEREAS, the City Council, under Resolution 85-808, authorized a reduction of the Letter of Credit to $120,000; and, WHEREAS, the City Council, under Resolution 87-761, authorized a reduction of the Letter of Credit to $70,000; and, WHEREAS, upon notice from the developer, City staff has inspected said site and recommends release of the financial guarantee; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does authorize the release of the Letter of Credit Number 1064 in the amount of $70,000, submitted by Healey Ra-ame Company for Timberton to guarantee site improvements for Timberton. FURTHER, Administrative Staff is directed to not issue permits for any new dwellings in this subdivision until plans have been approved and applicable site performance agreements and financial guarantees have been provided, in accordance with the Zoning Ordinance. The motion for adoption of the foregoing Resolution was duly seconded by-, and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergmm, Councilmembers Helliwell, The tollowing voted against or abstained_ Whereupon the Resolution was declared duly passed and adopted.
