HomeMy WebLinkAboutCity Council Resolution 1991-362CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held -on the 1st day of July , 19 91 The following members were present: Ma or Berown, Councilmembers Helliwell Ricker Vasiliou and Zitur The following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 91- 362 APPROVING A SITE PLAN FOR A PARKING LOT EXPANSION AND A VARIANCE FOR A DRIVE AISLE SETBACK FOR QUANTUM DEVELOPMENT INC. (91032) WHEREAS, Quantum Development Inc. has requested approval for a Site Plan Amendment for a Parking Lot Expansion and a Variance for a drive aisle setback for property located at 12325 Highway 55; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quantum Development Inc. for a Site Plan for a Parking Lot Expansion and a Variance for a drive aisle setback for property located at 12325 Highway 55, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements for completion of improvements within one year of the date of this resolution. 3. All signage shall be in compliance with the Ordinance. 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. This approval contemplates the occupancies proposed and approved at this time for the portion of the existing building shown on approved plans. 5. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 6. All waste and waste containers including recycling containers shall be stored within the approved enclosure, and no outside storage is permitted. 1. An 8h x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. Page Two Resolution No. 91-362 File 91032 8. A variance is approved for drive aisle setback to the west property line of 20.5 feet versus the Zoning Ordinance standard of 30 feet based on a finding that the Zoning Ordinance variance criteria are met. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell and upon vote being taken thereon, the o owing voted in favor thereof: Mayor Bergman, Councilmembers The following voted against or abstained Whereupon the Resolution was declared du y passe and adopted.
