HomeMy WebLinkAboutCity Council Resolution 1991-361CITY OF PLYMOUTH Pursuant to due call and notice thereof, a re, lar meeting of the City Council of the City of Plymouth, Minnesota, was hem—on the 1st day of 19 gl_ The following members were present: sr� Councilmembers Helliwell Ricker Vasiliou, and Zitur The -following members were absent: None Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION 91- 361 APPROVING CONDITIONAL USE PERMIT FOR QUANTUM DEVELOPMENT INC. FOR FAMILY CHILD DEVELOPMENT CENTER FOR A PRIVATE NURSERY SCHOOL. (91032) WHEREAS, Quantum Development Inc. for Family Child Development Center has requested approval for a Conditional Use Permit to operate a private nursery school occupying 20,000 square feet of the structure at 12325 Highway 55; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quantum Development Inc. for Family Child Development Center for a Conditional Use Permit to operate a private nursery school occupying 20,000 square feet of the structure at 12325 Highway 55, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 2. The site shall be maintained in a sanitary manner. 3. All waste and waste containers shall be stored within approved designated areas. 4. Signage relative to the use shall be per ordinance standards and the property owner shall apply for any permits and shall account for total signage for the building. 5. The permit shall be renewed annually to assure compliance with the conditions. 6. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 7. Operating hours shall be 6:30 a.m. to 6:00 p.m. weekdays. 8. Maximum enrollment, including any secondary uses, shall be 250. Page Two Resolution No. 91-361 File 91032 9. A copy of the current State operating certificate and/or license shall be kept on file with the City. 10. The permit shall not be issued until the required building improvements and site improvements have been completed and have been approved by the City. 11. The authorized occupancy is for only that portion of the existing building shown for this use on the approved plans. Additional or expanded occupancy of the remainder of the existing building is subject to ordinance and code requirement. No variances from ordinance or code standards regarding uses that are allowed on this property are granted or implied by this action. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Helliwell and upon vote being taken thereon, the following voted in favor thereof: M„ny BP,� n.
