Councilmembers Helliwell, Ricker, Vasiliou, and Zitur The following members were absent: None Ma or Bergman introduced the following Resolution and moved its a op -J on : RESOLUTION 91- 359 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN CONDITIONAL USE PERMIT AMENDMENT FOR DON HUNGER (91027) (RPUD 84-1) WHEREAS, Don Hunger has requested a Planned Unit Development Plan Conditional Use Permit Amendment for property located at the 10625 48th Avenue North to allow for a reduced sideyard setback from 10 feet to 8.2 feet; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Don Hunger for a Planned Unit Development Plan Conditional Use Permit Amendment to allow reduced setbacks for property located at the 10625 48th Avenue North subject to the following findings and conditions: 1. No other amendments or variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3. The granting of the Permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. 4. A sideyard setback of 8.2 feet is granted on the west property line to permit the construction of a third garage stall. The ;motion ror adoption of the foregoing Resolution was duly seconded by. Councilmember Ricker and upon vote being taken thereon, the following voted in favor thereof: Mayor Berman, Counci]members Helliweil, Zi_tur The to owing voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
