HomeMy WebLinkAboutCity Council Resolution 1991-357CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reE;ular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 1st day of July 19 91 The following members were present: MTyo1 Berman, Councilmembers Helliwell Ricker Vasiliou, and Zitur The following members were absent: None CQ=cilmem r Zitur introduced the following Resolution and moved its adoption: RESOLUTION 91- 357 APPROVING AMENDED CONDITIONAL USE PERMIT; SITE PLAN FOR ADMINISTRATION BUILDING; AND VARIANCE REQUEST FOR THE ASSOCIATION OF FREE LUTHERAN CONGREGATIONS (91020) WHEREAS, The Association of Free Lutheran Congregations has requested approval for an Amended Conditional Use Permit for the General Development Plan; Site Plan for Administration Building; and Variance request to allow more than one structure on a single parcel of record for property located 3110 East Medicine Lake Boulevard; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and reccwnnends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The Association of Free Lutheran Congregations for an Amended Conditional Use Permit for the Master Development Plan; Site Plan for Administration Building; and Variance to allow more than one structure on a single parcel of record for property IDcated 3110 East Medicine Lake Boulevard, subject to the fol i,wing conditions: 1. Compliance with the :ity Engineer's Memorandum. 2. Park dedication has been satisfied for the site by prior action. 3. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 4. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution. 5. Any signage shall be in compliance with the Ordinance. No new signage is hereby approved. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. (see next page) Resolution No. 91-357 Page Two File 91020 7. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 8. All waste and waste containers (including those for recycling) shall be stored within the approved enclosure, and no outside storage is permitted. 9. An 8h x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 10. A variance to locate more than one structure on a parcel of record is approved based on a finding that the variance criteria are met based upon the approved General Development Plan for this property. 11. Construction of the 34 parking spaces along the north border of the site may be deferred until such time that either the owner or City determines the spaces are needed for the allowed uses on the site. No variance from Ordinance minimum standards is granted or implied. 12. The Conditional Use Permit Amendment approved is to allow a change of use location on the General Development Plan to exchange the "Housing for the Elderly" location with the "Administration" location. No other changes are approved for the General Development Plan approved by Resolution 73- 410. 13. Compliance with all applicable conditions of Resolutions 73-409 and 73- 410. 14. The property owner shall submit a revised General Development Plan for the complete site showing the Plan features, as approved here prior to issuance of a Building Permit for the administration building. 15. The landscape and grading plan dated June 27, 1991 is approved to provide enlarged berms and the planting of conifer trees along the north property line in lieu of the six foot board -on -board fence shown on the original Site Plan. 16. The Conditional Use Permit is specifically for the use of the Administration Building by Association of Free Lutheran Congregations and its affiliates. No commercial leasing of office space to the public is permitted. The motion for adoption of the foregoing Resolution was duly seconded by - ember Helliwell and upon vote being taken thereon, the following voted in favor thereof: Mayor Bergman, Councilmembers Helliwell, Ricker Vasiliou, and Zitur _ The tollowing voted against or abstained None Whereupon the Resolution was declared duly passed and adopted.
